Another tale of eBay woe

I just can't believe some people.

 

We won an auction for water damaged software last week. Adobe Pagemaker. Paid him straight away with Paypal on his terms.

 

A week later no product, but I get a refund. Strange.

Then an email arrives explaining that his insurance company is paying for the damage to the goods so he can't sell them.

 

So he put up on auction goods that he'd claimed on his insurance for.

 

Great. Naturally I left feedback.

 

"Complete time waster! Refunded me as it wasn't his to sell due to insuranceclaim"

 

He requests I remove the feedback as he refunded me, but I refused as I'm annoyed I didn't get what I'd won.

 

So what does our idiot friend do? Puts up the following on his.

 

"FRAUD - Paid with stolen credit card - Police investigating - stay away from him"

 

and leaves feedback on us:

"!!!WARNING!!!AVOID!!!CHEAT!!!FRAUD!!! Ebay investigating numerous claims"

 

What a complete lying b*start piece of sh*t!!!

 

Then I get an email from eBay saying there's a request to mutually withdraw bad feedback.

 

There is no way I'm letting him get away with this blackmail. eBay is a complete joke.

quite simple. just tell ebay you dont want to mutualy remove feedback and request that they remove the lies on yours. It should be easy for them to check the "multiple claims" for themselves and see that you have probably had none. They can also probably check you "stolen" credit card if you have been useing paypal for some time with them.

Ebay are complete to$$ers when it comes to feedback. They absolutely will not remove feedback, however libelous and unjustified it is, and although you can sue the guy for libel its probably not worth it.

Even if you agree to withdraw the feedback, it only gets rid of the red mark in your score, the comments stay in the list. Best thing to do is to reply to the feedback before you withdraw it - then set up several fake accounts (preferably from several ip addresses and screw up any future sales the guy trys to make.

I got left negative feedback one time when there was some random hacker type guy creating fake accounts and buying buy-it now auctions with no intention of paying, then leaving negative feedback. A few others got hit by the same guy too. I complained to ebay, providing them with all the info, and about 2 weeks later, the negative feedback got removed, and the hacker guy was no longer a registered user (until he comes back via another fale account under different ID etc).

 

Ebay is good for most things, but theres a hell of a lot of dodgy gits on there abusing the system.

You could try threatening him with legal action for libel, which that clearly is.

Interesting, although I suspect the eBay lawyers are better than ours and they will have it all covered in small print somewhere. eBay is so worthless to us it's not a good use of my time. I'm just venting off anger.

To be honest I would of left neutral feedback. He returned the money and explained, its better then no money and being ignored, thats negative.

In hindsight I ought to have done that, you're right.

 

They're still listing similar product. I'm suspecting that he's maybe selling dodgy licenses and crapped himself when they saw we are an IT company and would spot this.

They did the right thing, handing the money in as they can now make a claim under the Police property Act after 28days. Although the money has been seized under the proceeds of crime act it hasn't been "seized" from an individual in posession so the Police Property Axct claim should supercede it.

 

As for the other matter Pete, have ebay removed the feedback left to you by the other party?

I would also seriously consider a claim against them for libel and defamation of character. A solicitors letter should do it. You have imo a good case.

 

Ebay I expect have the get out clause as indeed we do if a complaint is made about a post we have a reasonable period to review it and check its accuracy either before removing it or keeping it. Ebay will be bound by those same conditions. If they haven't removed them, then you'll have a good case against them as well. The downside is that afaik for defamation and libel you can't get legal aid and I don't think you can go down the no win no fee route unless you have some form of legal protection insurance. But certainly worth a chat with a solicitor to see how you stand. Especially if you are still working as a special.
