Recompense from private sales

As one of the people who posted in this thread I have to say that I object to the thinly veiled accusation that I / we somehow disrupted the thread in the dispute section. I can see nothing posted in this thread that couldn't be perceived as common knowledge and as such, could have been posted anywhere.

 

Now, if I am wrong here and the rules have changed to say that no member is allowed to post anything relating to a dispute outside that dispute forum, then please let me (and others) know so that we will not break this rule from now on.

 

Look, I'm not going to be drawn into this any further.

 

I've not made any accusations but you are missing the point of the disputes section of the forum entirely.

Really? Up until now it seems to have been highly effective a resolving disagreements amicably.

I thought the process was meant to present all the facts with no hidden behind the scenes activity?

 

We should remember that it's just a car club at the end of the day. If someone has been accused of giving a raw deal with a lot of money involved I'd fully expect them to stick two fingers up at the club and disappear happy in the knowledge their cash is quite safe (given as we've discussed above the low likelihood any legal proceeding will be a success). Clearly not the best outcome and to be avoided at all costs.

 

It's up to the people involved to decide an agreeable outcome and not the Mediator, they are there to present the facts and work each side to a solution somewhere in the middle.

 

To be fair the whole situation is a bloody mess and I wish those involved luck in resolving it to their satisfaction.

Hopefully this will clear up why what's happened has happened, it's all in the dispute thread but it might be easier to put it in one go to save speculation. I'm not going to post any more than this because frankly I've had enough and have no choice but to go down the legal route.

 

I've been passed from pillar to post on it. I bought it from Rovervi who literally had it a day as he realised it had a few bits missing in order to do a na-tt conversion, it turns out not to be what Coldflame sold him. I however had those bits on my old engine so not an issue (I thought). I bought this on the basis of what he told me needed doing and what he had been told by Coldflame and his garage about the engine. I had not seen the engine in person and had to go by what I was being told, however what I was told was wrong.

 

Coldflame then tried to pass the buck to Keron, which got flamed down by Keron only because I invited Keron to the thread, not Coldflame, as he knew what the response would be. From what I can tell Rovervi either knew some of the issues and passed it on knowingly or was going on what he was told by Coldflame. Either way it's miss-representation of the state of the engine as the sale was based on information provided (which I have documentation of), not just sold as seen, and relates to the miss-represtation act (whether knowingly or innocently).

 

My action was against Rovervi to start with, who wasn't prepared to offer anything unless Coldflame did etc etc.. He wasn't very helpful in pursuing this, so I did so. If I went to court it has to be against rovervi, but he will in turn go to Coldflame as Coldflame also missrepresented the engine to him, so instead of 2 dispute threads I thought let's resolve it in one and try and save hassle and cost all round.

 

What's happened is I've ended up with all the hassle as Rovervi's sat back and watched and didn't dispute it with Coldflame to resolution, and now we're back to square one anyway, with me taking rovervi to court (and subsequently Coldflame as he can apparently be invited into the same case, which he will be). The offer of refund made was impossible to fulfill even if I wished to do so, and Coldflame knew that as he was aware of the sale of the wiring loom.

 

I tried to help another member by taking on his case as well (as he wasn't exactly forthcoming with the assistance), as I thought it would lead to quicker resolution, but it's all turned crap. Luckily for me my legal costs won't be that high as my friend is a lawyer who deals with these types of things and advises I have a very strong case, especially considering a refund has been offered therefore admitting liability (along with Barclays legal advice which I also gain for free:))

 

Hopefully that helps clear it up, joy of joys...watch out in the new year for the result. You guys can talk about it all you wish if you like, but that's all I'm saying on this now as I'm going to pass the details on and forget about it and try to enjoy xmas
