There has to be a 30 day consultation period if there are to be 20-29 redundancys or 90 days if there are more then 100 going. This is the time from being told you are at risk to when you leave. If it can be shown you didnt have the minimum consoltation period you can claim at a tribunial and be awared some extra pay.

 

Legaly you have to be payed your notice period even if you dont actually work it. You should also get some pay depending on your length of service. Currently it is 0.5 weeks pay per year for those under 22. 1 weeks pay per year for 22-40 and 1.5 weeks of pay for those over 40. A weeks pay is capped at a maximum of £310. This is the statatory minimum. Most employers would honour your usual weekly pay or something. You should also get any outstanding holiday pay or you will have to pay them if you have taken more then your pro rata share. Your notice period and holiday pay are all taxed as normal but your redundancy money should be tax free. Anything over 30k is taxed.

It might be worth trying one of the no win no fee companies, don't know if they deal with issues like this, but at least then if it doesn't work out you won't have to pay a fortune.

 

Have you tried ringing citizens advice? They might be able to tell you specialist solicitors in your area.

 

Also, could be wrong but I thought your 1st hours consulation with a solicitor was free?

I got about an hour of consultation like Jake, basically it involved me negotiating to take IT equipment in lieu of a decent redundancy payment. This came after pay cuts, a 3 day working week and earlier redundancies with a much nicer payout so it wasn't entirely unexpected.

Age is taken into account with redundancy, if you are under 22 you get 0.5 weeks for each year worked, 22 > 41 is 1 week and 41+ is 1.5 weeks.

 

Lots of info in that link anyway, might be useful to get up to speed before you seek legal advice so the basics are covered without it costing you money :)

To be honest, at my age (25) I am not too worried about redundancy as I do think I'll find something else (probably better too :) ) quite quickly. Well, here's hoping anyway.

 

The package I am being offered is what they call a "compensation package" - they totally ignore the legal amount they have to give, and they come up with a figure themselves. This figure for me is quite a lot more than the legal minimum, but that's not the problem here. We're all basically fed up of being messed around, promised one thing with one hand, and then it's taken away with the other before we get it. And they are now discriminating (to some respect) against us in favour of those who currently are not in their consultation period. (... But are 80% likely to be in theirs in a matter of weeks/months anyway.. not like they need the old payroll team once everyone is on the new contracts etc...)

 

I am rambling here (getting thoughts together) but I think if I threaten seeking legal advice that they have to pay for anyway, they may be more willing to negociate....

 

I think, for me, comparing the current contract and the new offer that we are not getting, I'm going to be worse off by around £1k. It's not a big deal, but hey - I'll fight my corner anyway and I may get a few hundred quid more. If you don't ask/try, you don't get....

Well, after some discussions this morning between myself and the other potential jobless folk, a couple of us decided to speak to the local CAB and find out where we stand.

 

As suspected, it is perfectly legal, but just a bit unfair/dirty. For those that have served longer than myself, they are losing out on a lot more than myself. I was only about £1k out, and I found out that I actually get a bit more than I thought today.....

 

For some reason there is a small lump sum paid into my final payslip that I wasn't aware of - I can't remember what it is called, but it's small and taxable. However, it all adds up.

 

Only a few questions remain (based on the bonus) as we are likely to achieve 150%+ bonus, but their calcs only work on 100% - so we need to get in writing that they will pay us the extra XX% assuming initial signs are correct.

Ah sux mate. Shitty time of year to loose your job. Not that any when is a good time.

 

We just had the same kind of thing happen at my Company.

 

I work in a Chemical place of just over 100 employees and we making redundant 29 Chemists and 2 other staff within the next 2 weeks now.

 

The atmosphere at work is more then solemn at the moment.
