NUTKIN Posted November 14, 2007 Share Posted November 14, 2007 please help i dont no what to do. i started new job as courier with own van which we found out was to small for job so boss said he would get me a company van an insure me on it. A week later he buys a white van an i drive it for a week then get pulled by old bill. the van had no tax which i new about but thought his van his fine as the owner. The problem was the van was still registered as yellow an green with no owner obviously the log book had not reached DVLA yet which after a week is dodgy. The biggest problem is he never took insurance out on it so im getting done for driving without insurace an if that happens i cant drive my supra with 6 points. How do i stand with this im bricking it he told me i was going to be insured an a week after im driving it i find im not still. If the Supra has to be sold as a result then sadly that's what has to happen. I can understand you not knowing about the colour change but the rest is basic stuff every driver needs to check, is the car taxed? Am I insured to drive it? I'd consider yourself lucky that you got pulled rather than finding all this out after mowing someone down. What does your boss have to say about the situation? This does not however extend to employees driving employers motor vehicles. If you are such a person facing a no insurance prosecution, you should contact us because there are circumstances where you may have a defence in law. I'm pretty sure its the driver responsibility to ensure they have adequate insurance etc but as an employee you expect your employer to make every reasonable effort to ensure the vehicle is legal. It may be an idea to also speak to a brief and/or an employment lawyer regarding the situation your boss has put you in - you may be able to push for a counter claim. Have you spokend to your boss? I would also urge your employer to speak to the police station who took dowm the offence and try and take the cop for the offence. You might be able to use the law on your side, the problem is that you admit you knew it was not taxed and still drove the thing. Of course that will get you in the poo at work though. Not taxing it could probably be brushed off to the owner, not sure as you were driving it though and it's the drivers responsibility blah blah. In all fairness to Nutkin there are some bosses out there who are right crunts! My ex boss had an eppy fit because I asked him to provide details of the car when I got pulled by the old bill. He said he was busy and didn't have time for all this shit..... I just got a Laguna delivered to work. I didn't check the tax disc and had never seen any documentation to show that we even owned the vehicle never mind insured it..... I didn't want to ask my boss as he was a serious arsehole! Sounds like you are not misssing out on anything as he sounds like a tosser of the highest order! I would get yourself a good solicitor and explain the situation to a magistrate! Be calm and explain that you wouldn't drive a vehicle without insurance and being new to the job you expected your new employer to provide the necessary tools to do the job!
