mathew Posted November 12, 2007 Share Posted November 12, 2007 last friday evening pull up to a junction behind a girl in a daewoo (sp) she goes to pull out so i look right to get ready and the car crept forward as it does when you let off the brake (auto) and as soon as it started to move,no more than 5 mph, it stopped on the bumper of the girl who herself had stopped for no reason. ok thats my fault. we both get out, have a look for damage and see nothing. i ask her is she ok and she says she's fine. we swap details just incase any scratches have been caused which havnt been seen due to it being dark. no probs all good so far. get home from work today and have a message to phone some dude back so i phone him. its the girls father who informs me she had to go to hospital with whiplash on the weekend and the car needs repair work!! i tell him i wanna see the car first before i give my details and he turns into a c*** on the phone so i told him il get back to him. so i payed the police a visit to inform them and because she is injured it gets classed as something else! i give the copper my story and he was getting wound up that these tw*ts are putting in for whiplash especially after he looked at the supra and all that was there was a tiny scratch! anyway the copper was decent and seemed on my side and is paying them a visit later to check out their car. im absolutely fuming right now especially with the tw*t i spoke to on the phone!!! now gotta exchange details which im tempted to tell him to f*** with but i know il get i even more shit. rant kinda over for the moment! Class One Posted November 12, 2007 Share Posted November 12, 2007 Personally, if I was involved in a touch, no matter how minor (like yours for instance) I would go to the Police station and fill out a self reporting form just to cover yourself, and also inform your insurance company. I appreciate that in 99% of cases that the party that goes into the rear of the other is at fault, but you can try and negate a potential situation as you've ended up in. My advice now to you (as you've done the Police thing) is inform your insuarnace compnay and if the third party or anyone acting on her behalf ( irate Daddy) just refer them to your insurnace compnay and have no discussion whatsoever with them at all. Don't under any circumstances deal with it by yourself, let your insurance company do the talking, that's what you pay the premium for. If they refuse to deal with your insurance co, tell them to shove it, if they want to claim, then claim from your insurance NOT you. For info if any party other than the driver is injured in a collison it must be reported to the Police as soon as possible and in any case within 24 hours. Makes you wonder why they've waited the whole weekend before getting in touch with you? I don't think (reporting wise) they'll be any comeback on you, as at the time no person claimed to have been injured as a result of the collison, so by exchanging details at the scene was enough to comply with your obligations under the Road Traffic Act. If Mat has only been doing 5mph then I doubt there is any "hidden" damage to the car. I also would expect that she's mentioned it to her dad who has then said "Oh, you should have claimed for whiplash!!" I have been around a bit and would like to think i know the difference between a crash that causes injury and one that is taking the piss!! I have had about 5 of my own as either a driver or a passenger. I have also been silly enough to nudge the back of a couple of cars in traffic while I have not been concentrating and let the clutch up a bit too far....... I would be furious if someone claimed a little nudge had actually caused them a serious neck injury.... On the other hand I do believe that you can do more damage to your neck by a good set of brakes applied being applied sharply!! There is a chance of some money for nothing and a little white lie could net someone a grand or two..... That's what it all boils down to unfortunately!! H. Whiplash is rediculous. i was in a passenger in a crash at 80 mph and suffered really bad pains for 2 weeks, then further back pains for 2 months. i was offered £1900 compensation! they just seem to base it on how much the victim lays it on, not actual facts involved. mathew Posted December 23, 2007 Author Share Posted December 23, 2007 just a little update on this incident. the insurance company got in touch with me and said that the other party have already trned down one compo offer for the whiplash and the daewoo matiz is still in the garage undergoing 'extensive' repairs! i only scratched her bumper! anyway all my no claims have now gone, bummer. i also had a letter off the police stating that after their research the police arent gona charge me with dangerous driving or driving without due car and attention which i didnt even know they were considering! guess i saved myself some worry there anyway.
