Debt Advise - Any Law people..???

Happened to a friend of mine.

 

He fell for this girl, bought her a car, washing machine and gods knows what else. After a 2 week holiday, the same day they get back she dumps him and says she's been seeing someone else for the last month. Thanks very much, now sling your hook.:blink:

 

That's as bad as theft in my book.

 

Not saying some blokes don't do the same, but either way people shouldn't be allowed to get away with it.

ill put it more clearly to you

 

youre in a relaitionship, you shell out a fortune to the other half (on there request) you stump up a couple of grand, then they bugger off with youre money and pride!

no one said anything about prozzers at least they dont hide anything:tongue:

now in that situ what would you do?

In a relationship I think both parties pay for things because they are in a relationship. I don't know the full facts of it so I can't comment either way.

 

Clearly some men think with their d*cks and not their brains.

Proceed through the small claims court. If you have enough supporting evidence that funds have changed hands then that should be enough. Ideally in the subject line for the paypal + bank transactions it should say "loan", but nothings perfect.

 

Once a small claim has been presented a claim form will be presented by the court to your ex. She has the decision to either file a defence (meaning her time+money) or ignore it. If she defends then it will be down to the decision of the judge. If your presentable and would make a good witness then this will help.

 

If she doesnt defend then the court will issue her with a writ (CCJ) ordering her to pay. If she doesnt payup or make offers to may monthly (schedule of payment) then you can request enforcement (further £25 i believe) to which the courts will write to her again. If this still doesnt work then you can also pay a further amount to the court for bailiffs to be instructed, obviously this is in the most serious cases though. And obviously until the CCJ is satisfied (paid) her credit rating will be seriously effected).

Do they take previous history into account in these situations? Like someone with a good credit history trying to claim something from a scummy tax evading benefit cheat?

Only if evidence of this is presented to the court. Such as history of the defendant being a previous bad debtor, ie a credit search result showing scoring + any previous CCJs. This is not accessible by the general public so doesnt normally become part of the case.

 

Even if a history of bad debt was presented it probably wouldnt have much effect on the judges decision. Being that it is subjective evidence and only shows the history, not the present....ie, they could be a 'reformed citizen'. However this is civil law so you only have to prove 'balance of probabilities' in your favour, and not 'beyond all unreasonable doubt' as you do in criminal law.
