SupraJames Posted September 26, 2007 Share Posted September 26, 2007 Ok have had this problem knocking about for a while now and thought I would post it up as their seems to be a lot of very knowledgable people on here and hopefully someone can help me out. Ok heres the short version, my ex girlfriend owes me £1600, for me buying a new engine for her car as well as lending her some money to pay off some bills. I have proof (bank and PayPal Statement) showing I have given her the money, but now she wont pay me back. The car which I bought the engine for paid for it to be fitted etc was written off a while back, and the insurance paid out in full, but instead of giving me my money back as I asked for, she went out and bought a new car. She also took out a loan to clear all her debts, again I thought this would mean I got paid off, but I was wrong again and she wont give me any money back. I have been reasonable with her and said if she cant pay it back in one lump to start paying me back monthly but again have have nothing. Just want to know if there is anything I can now, have thought about small claims court but believe I need in writing all the details of the loan, and set up repayment details and dates, i.e. when she would have the money paid back by etc etc. Hoping someone can help, if this was like £200 I would write it off and put it down to experiance, but £1600 is money I could really do with and would help towards getting my business off the ground. If not it is your word against hers that the money was not a gift. Her being your girlfriend at the time (and judges being old horny men) it is likely that they will take her side. If you paid by paypal have you tried claiming though paypal that the 'item' you bought from her has never arrived? I think you only have 60 days to do this but if you are in that time limit if you file a 'item not recieved' complaint and escalate it, paypal will debit her account and refund you. To prevent you from doing that she would need to provide proof (signed proof of postage) - which obviously doesn't exist. Link to comment Share on other sites More sharing options...
SupraJames Posted September 27, 2007 Author Share Posted September 27, 2007 No contracts were ever drawn up, and court is something I would really like to try and avoid, but I did state it was a loan and she has stated to me she will pay me back, but then claims never to have any money. PayPal only protects payments made against Ebay items sadly. Also the money was not paid into her account but into the account of of the company where the new engine for her car was bought. Or is she just putting the whole thing off until 'tomorrow'? I think it's important to understand that first. If the former, then you have an issue at hand. If the latter, then surely it's just a matter of talking it through with her and finding a repayment solution that you can both agree? I would personally spend the £30 and go to small claims court. I had to do something similar with a family member who owes me £3500.... I phoned him up, had a few words and said 'Enough is enough, I know we are mates, but unless you pull finger I'm going to claims court'... He sorted it then and there... SupraJames Posted September 27, 2007 Author Share Posted September 27, 2007 Gav, I have mentioned the small claims court to her, and she came back with, "well you dont have it in writing that I would pay you back in full by any certain date" so im not sure that a court would side with me, and if I end up loosing I will be even more out of pocket. She's obviously giving you the run around hoping you'll give up, and the "well you don't have it in writing" comment sums up her attitude. 1600quid or 16 quid, it doesn't matter. hogmaw Posted September 27, 2007 Share Posted September 27, 2007 Wait a minute! The fact that you don't have anything in writing doesn't mean you can't take her to the small claims court. She has already agreed that she would pay it back, and if you sit in front of a court official and put your case forward then she would have to blatantly lie in order to get out of it. Most people in that situation would succumb to the pressure, tell the truth and admit that they have a debt to pay, regardless of whether or not anything is in writing. I bought an ex g/f a car, and obviously - since it was a gift - she kept it when we split up. If I had decided to be nasty and take her to small claims court, I'd have no proof that it was a loan (as I'd be claiming) and she would be saying it was a gift.
