Am trying to do 4Hrs a day at work but am getting headaches etc but i am struggling on as i want to get back into a normal routine and put the attack behind me as much as possible. I was talking to a colleage about his trip to London when one of the other techy's comes in who is nick named "pikey". Pikey can see/hear we are talking but butt's in anyway, this is not the first time he has done it and i have asked him many times in the past to dissist. I then tell the idiot to shut up as we are talking and f*&k off to his desk. He slops off to his desk then goes to the sink to make himself a cup of tea. He then comes back in and says that i probably asked to be attacked by gobbing off at the people who did it, this was so not the case. I swear at him and say he knows nothing about it and to mind his own f'ing business, he continues to say that i asked for it. I then lose my wrag, get up and walk to his desk, throw a Cat5 cable at him (could have been a cross over!) and tip his speaker over into his lap while giving it a load of anglo saxon and suggesting him come outside and i show him what its like to be attacked. At no point did i strike him. I go back to my desk and grit my teeth before leaving to go for a walk to calm down. This all happened wednesday. Today i find out HE has put a complaint in against me and HR are investigating it. Other than not throttling the little tit so he could not utter another word what did i do wrong?? In theory you should have risen above it BUT I've been in a similar ish situation and someone kept pushing and pushing and it's the only time I've totally lost it. They must write to you and give you notice of an investigation and tell you the nature of the complaint Tell them what happened to make you behave as you did as these are strongly mitigating circumstances particularly in light of your recent attack. Tell them the idiot is constantly annoying folk and that you felt strongly aggrieved and lost your cool because of his taunts, despite you asking him to butt out. It is not usually the case now for someone to get dismissed for gross misconduct for swearing; but actually physically going for someone ie throwing something might be a step too far. If I were listening to this case; and I deal with quite a few; I would definitely give you a letter of concern only; if your previous employment record is good. Keep your emotions under control in the office m8 its not the right place to get uppy. hope this helps. I think you are lucky not to have been given the bullet for your reaction, although he has also provoked you too. You need to play the game mate and not let people wind you up....(says he.) He has obviously pushed your button by refering to your recent attack which is a bit of a cheap shot really! I would just explain to HR that your are still traumatised by your recent attack and when a colleague interupts you and then makes reference to your recent misfortune then most people would get annoyed! Stay calm and be apologetic and show that your are the reasonable party. Then let Pikey go in and see if he can do the same. You never know, he may be thick enough to admit that he provoked you.... Think of it in terms of a CCTV operator watching the footage of the incident. Without knowing anything about you two, how would you fare? In some cases both parties get the sack, without much investigation on who started what. It sucks, but that's how it goes. For instance when he came over you should of said were talking can come back. Not fuck off. If you worked in my team i would have suspended you and from what you said you'd be sacked. Hey in todays equal world we're not even allowed to say things like 'old git' or 'whipper snapper' in the work place no more, as thats classed as a descrimination or ageism..........fooked up or what but thats the sort of world we're in now...... But I would use your recent events as reasons for you loosing your temper, and the fact that you have asked him politely before not to do exactly what he did again......
