*Squirrels that one away for a rainy day*... jees. I am sure I would accept that as a valid excuse for someone climbing on my daughter for a romp while she yelped NO! Erm... if he knew he was prone to that sort of behaviour, shouldn't he be seeking help? I would like to see evidence of him recognising his problems (if previous evidence of behaviour is being used in evidence for his defence) and seeking professional help, not some testimony from his missus that he fondled her bits whilst sleeping! (another *yeah roight* moment). A bit of a step up from peeing in the cupboard methinks.

That was one of the cases Lin was offered when she had to do jury service a few weeks ago.

 

She turned it down and opted for a plain old ABH case instead.

 

 

 

When she finished I asked if they'd found the guy guilty or not. She said "I'm not sure I'm allowed to say yet because he hasn't been sentenced yet."

Watched a Discovery channel programme a few weeks ago where a guy murdered both his inlaws whilst sleep walking. He drove from his house to theirs and woke up the inlaws all whilst sleep walking. The story goes that they tried to wake him and he got violent (common if sleep walkers are woken suddenly) he started to strangle his father in law, the mother tried to stop him by getting a kitchen knife, but the guy turned the knife on them both.

 

There was a long family history of sleep walking, his grand father use to cook in his sleep and other family members sleep walked as well.

 

He was cleared of murder by the jury. The programme made a convincing case for how the guy could have done all these things whilst technically he was still asleep (even though his eyes were open).

If he had a history of this going back a considerable time, why wasnt/isnt he on medication?

 

It seems that seemingly implausible medical conditions are treated plausibly in court and an excuse for, literally, getting away with murder!

 

castrate the lying b@stard I say :wtf:

 

....oh, and while they're at it bring back hanging!! :eyebrows::hang:
