carl0s Posted May 25, 2007 Share Posted May 25, 2007 So, I sold this item : clicky on eBay on 5th February, after deciding I didn't have enough time for Asterisk and SIP telephony in general. I didn't post the item until two days after the auction ended, and I got a pissy pants whiny message crying that "it's just not fair. we paid you straight away, and we were going to buy ten more of these of you." To which I replied that I had a lot of work on, I had to find suitable packaging material, and I had flashed the firmware to the latest version for him since it had been out of use for some months, and that I didn't have ten to supply him anyway. No worries, he left positive feedback. Now I get this message from the whiny little bitch: Hi Carl, We bought the above item from you in early February. The unit has now given up the ghost and Portech the manufacturer are not interested in replacing/supporting the item due to the unit has been open by yourself. We know you have opened the unit as we have found the picture's you posted on a forum about the Gateway and the problems you were having with the unit. Therefore you have sold us a unit, knowing it is faulty. Then of course you have taken our money for the unit, once again at this point knowing still the unit you was shipping is faulty. I hope we can sort this situation out regarding the GSM Gateway. We are willing to accept a refund the item in these circumstances. If we cannot come to any agreement regarding a replacement unit or a refund, I will have to contact my Credit Card Company (LloydsTSB) and return the payment for faulty goods received. I posted pictures for the benefit of people interested in the technology. What fault are you referring to that I am supposed to have known about? It seems to me that the unit has been working fine for you for the last three months and now that it has developed a fault you’re trying to get a refund. I didn’t sell the unit with a warranty and nor did I sell it on the basis that I had never taken a look at the insides. So then, please tell me what this fault is that I am supposed to have known about all along. Regarding Portech, I wouldn’t expect them to support the unit anyway since it’s probably nearing a year old now, was bought from an Internet auction, since resold on an Internet auction, and they’re a Taiwanese manufacturer. Anyway, how would they have known it had been opened (as if they would care)? In short, you’ll not be getting a refund from me and I think you know as well as I do that it’s a ridiculous thing to expect. You bought the WORKING item from an internet auction and it has developed a fault months later. Tough luck. The only issue I had was that the webserver didn’t like dealing with Firefox, so I used Internet Explorer instead. I did however flash updated firmware to the device before posting to you anyway. To think the fact that I undid four self-tapping screws and took a couple of photographs would make me somehow liable for it stopping working months later is farcical. Do you try this stuff on with everybody? I suspect most would have just ignored your email, and to be honest, if you feel like pursuing the matter then that’s probably what I will do. I actually thought about buying another the other day because you can use it by itself, so it could route an incoming 0845 number from SIPgate over to my Orange phone. Well sort of, it'll divert SIP. It doesn't have an analogue input (FXS / FXO). You've got an Asterisk box at home though haven't you? Used items (sold as seen) do not come with any warranty unless the manufacturer's warranty is still valid and transferable, or you offer it with a warranty yourself, which you didn't. If it was fit for purpose when sold, which he has admitted, then you have fulfilled your end of the deal and are not liable for any later breakdown.
