mathew Posted March 7, 2007 Share Posted March 7, 2007 had the letter through today for speeding in the works van back in october 2006! looks like it has been sent to the company first then my name given. it gives the name of the road which i was caught on. problem is i cant remember where i was working that day and also other people use the van. it also states that it was taken at 13.32, i finish work at 4.30?! my name is also spelt wrong on the form if that gives me any kinda foot to stand on. also should the punishment of points and fine be stated anywhere on the form? advice on what to do with this would be very welcomed. chilli Posted March 7, 2007 Share Posted March 7, 2007 I know nothing about the law, but unless they have some evidence you were actually driving it then, surely they can't make it stick - especially if there is reasonable doubt that someone else could have been driving it? if the driver can't be named, I think the owner of the vehical gets done by default, iirc good luck anyway! They should have offered you the option to request the photographic evidence. They do charge for this though!!. You need to get to the bottom of who was driving. I looks as if the company may have had the NIP for a while and that they or the police have taken a while to sort it out. As long as the original NIP is sent out within 14 days you are in the shit. I used them for advice to get a Notice of Intended Prosecution dropped, because the Camera Partnership had sent it too late. Even had a letter of apology With what you've said so far wrt working out who was driving, length of time etc, it sounds like you've got plenty of possibilites to check up on! Best one is making your work prove you were driving, as it's their responsibility. So long as you show reasonable diligence in trying to find out who it was you should be ok. CJ Posted March 9, 2007 Share Posted March 9, 2007 My only concern would be that while you are merrily getting off from the offence, your company may then get fined big stylee - and I wonder how they would view that given that you have already said that the driver must have been you due to the road you were on. If it is a simple 3pts and £30 then my advice would be to take it on the chin rather than feck up your relationship with your employer.
