Conrad
Ok so I got flashed Xmas eve by a camera near my house - doing 39mph in a 30mph. (damn camera right on the edge of a 40 zone -gets everyone ) I've already got 7 points as it is and now expect another 3 totalling 10 points . Does this mean that should I ever get another 3 points I'll have more than 12 and will be banned? It might sound daft but I don't know how I've managed to clock this many up - I always considered myself a safe driver! Obviously not
rpslaughter1982
Short answer is yes. After I believe 3 years the points are taken off though so it depends when you got your 7 points
Class One
Under totting up 12 or more points can equal a ban but in some cases courts have been known to waiver the ban. Endorsements count for 3 years and stay on your licence for 4 years (iirc) so totting up will only count for those endorsements received in the last 3 years. Conrad
Oh good - thanks for that. My oldest endorsement is from August '04 which is for 4 points. I'm off to live in Canada in a couple weeks for 6+ months so luckily those 4 points will no longer count just after I return. Just some real careful driving in mean time! GeordieSteve
Not all the time. I have 15 points currently
Conrad
Not all the time. I have 15 points currently Yeah, I had heard that some people are let off with the ban due to work etc. Saying that though, my mate just told me that a lad we know got twelve points and the ban - but had to re-take his test too!! Don't know what his circumstances were for him to have to retake his test. Maybe he hadn't long passed or something.....
ivan
Here's a question: Is it legal for insurance co's to ask if you've had any endorements in the last 5 years if they come off your license after 4? Isn't that a little bit like the Rehab of Offenders thing?

I thought it was 5... that is good news then in my case...
markjodrell
I doubt you would get a ban, just wear a nice suit and say you need your car to take granny to church on Sundays. If the worst came to the worst you could get 2 or 3 months ban:(
jazz1
theres many ways out of this go to your local garage and pay them to say they had ur car, unless u filled out the letter
AlanM
Not that easy Jazz, if you are charged within a month of the offence you have to be aware who was driving your car at that particular time

Class One
think this applies to new drivers (under 2 years experience) only i think and also for what offence Yep new driver rules are different in as much as 6 points in the first two years leads to a compulsory ban and re test. Failure to disclose is a big naughty under the new fraud act (though it was before but it's easier to prove now), rehabilitation of offenders act doesn't come into it I'm afraid.
