does anyone know anything about collateral warranties??

slowly reading through stuff here and starting to make a bit of sense.

 

the overall question goes something like this.....

 

how has the doctrine of privity of contract and economic loss in the law of tort lead to the increase in usage of collateral warranties?

Ahhhhhhhhhhhhhhhh a law question relating to construction.

 

Or is it more contract related, what module are you doing and what level are you at.

What exactly do you want to know?

 

collateral warranties are normally between a Sub-Contractor and the purchaser/ Tennant.

 

In that...................... Budget Builders are employed by Perfect Hotels to build a hotel.

 

Perfect want a collateral warranty for Steel Work.

 

Budget Sub-Contract the Steel work to J.Smith Steel.

 

Budget builders arrange a Collateral Warrenty between J.Smith Steel and Perfect Hotels.

 

This is done to remove liability from the Main Contractor, Budget Builders. If the building falls down because the steel fails it's J.Smith Steel who pays.

 

It removes risk from the contractor whilst giving the client/ purchaser satisfaction in having a technically an insurance on the steel work.

nice one rob i owe you big time!

 

im half way through a degree in building studies and got a law module, mainly regarding contracts between sub contractors and clients etc

 

i was gona cut it short but think i might go all out on this one now :)

 

il throw in a mention in the bibliography of you rob :) .
