When I looked over at my passenger seat I found a lit cigarette burning a hole in the bottom of it. It had been flicked out of a passing car and gone through my window that was down by about 3" and rolled down the back of the passenger seat burning it as it done so. I would imagine this is quite unlucky but just goes to show that a lot of smokers dont seem to have much consideration for other people when they discard there cigarretes. It's annoying enough when it bounces of the front of your car let alone lodges in your motorcycle helmet or worse. I agree that you should not have to pay a fine if it was not you but by the sounds of it, it could well of been you at any other time. I have never understood how a law can say you are not aloud to drink, eat or answer a mobile phone in a car yet smoking a cigarette is fine. Surely it's just as dangerous. Plus the fact you've done absolutely nothing wrong except exceed an arbitrary catch-all speed limit. No litter, no-one hurt or inconvenienced, no mess, no lives put in danger (because if you were driving dangerously then, er, you'd be done for driving dangerously). Not a good example to use. I don't consider breaking the speed limit to be a crime in the slightest. Excess speed for the conditions, yes. But you can't sign & fine for that Smokers should reap what they sow. If I had my way you wouldn't be able to have the windows open while smoking, never mind chucking the fag butt out. Oh, and you'd have to pull over to smoke as it's such a massive distraction. Think I just answered that one... if there's a bike there I ain't gonna lob it am I! the lobbing it at people is only part of the problem. regardless of whether it hits a biker or not it's still going to end up on the ground instead of in the bin. this country is in a big enough mess without people just dumping crap on the road when there's no need. it's basically the same as fly-tipping and as such i think that you should be fined for it. as Pete has said, just pay up and don't do it again. Even though littering is now an arrestable (along with everything else) offence (so, in theory people could be arrested and held for up to 24 hours for dropping a cigarette butt) it would be near impossible to justify their detention to a custody sergeant. Also the crown prosecution service would never run a littering offence at court for a single cigarette butt. So, if Police are not able to secure a successful prosecution I wonder how local authorities are managing it if someone contests one of these fixed penalty tickets?? Dorset seem to manage it quite well. Quite a few successful convictions to date, most originating from the eye-witness account of a council employee on their way to / from work. County Court appearance if you deny the offence. Loved the story of the guy done for throwing chips out of his car window...got done by two counties as the discarded chips straddled the border. As for all the sarcy comments, keep em coming guys, I need all the help quitting smoking (fags, not chips) as I can get. I'm on a wobbly seven days so far.
