If you were over the speed limit then its down to the courts??? Depends if it can be proved and if anyone was injured. The person performing the manouvre must always ensure it is safe to do so before moving off. They are joining a road with traffic so must always give way. Guest Painter Posted September 20, 2006 Share Posted September 20, 2006 If it's as straight forward as you say, it would be the other drivers fault, as you were already established on a main road. Of course, the other driver could say you was speeding etc etc, but if it's just a case of him pulling out on you and causing a crash, it would be his fault. If this ever did happen, make sure the other driver drives off first after you have exchanged details, this way if he denies it was his fault later, your mate Dave can become a witness Quote Link to comment Share on other sites More sharing options...
