Stu_Fraser Posted August 13, 2006 Share Posted August 13, 2006 Ive been sent a NIP through the post for doing 87mph in a 70 zone. However there is an inconsistency on the form in the fact that they have spelt my name wrong. My dad seems to think that any inconsistency on the NIP and its not worth the paper its written on. This is because my mother was caught by a mobile speed camera doing 40 in a 30, but when she was served with the NIP it said she had been on a particular road when in fact she had not been on that road at all. The police even sent out the photograph of the car and it obviously was my mother driving the car.......... my dad argued that she had not been on the road stated on the NIP and she eventually got off. So what do you lot reckon, is it worth taking any action to see if i can get away with it or should i just accept responsibility and take the points?? colsoop Posted August 13, 2006 Share Posted August 13, 2006 Wait till 2 days before the 30 day deadline to name the driver and send back a letter recorded delivery stating that this person (wrong spelling) does not exist, however this person (you) does exist at this address, they will probably try and send you another NIP with the corrected info but the 14 days would have elapsed since the roiginal incident so it is void. It would be better to simply state that this person is not known at this address. This is a true statement. No need to specify anything extra, no need to sign either. Let them send more letters to clarify things if they so wish. Time is on your side. No rush to respond, you could be on a business trip or holiday for all they know. The mail could even be lost in the post, they have no way of proving receipt without a signature, despite what they claim about their 'outgoing book' being enough evidence in court. It isn't. Thats what i was gonna do, isnt a NIP a legal document so it should therefore be accurate, as it isnt in this case they dont have a leg to stand on?? Mike Posted August 13, 2006 Share Posted August 13, 2006 I had this last year.. got a letter saying I was going to get a court summons because I'd ignored the previous letters etc. They had my name and address wrong.. so I was thinking the same.. keep quiet.. as the second letter had come via a neighbour... then I checked my log book and doh! the stupid bloke in the garage had put my details down wrong and I stupidly hadn't checked... so I had to own up and take the points... I called them and because it was an 'honest' mistake (thank the lord!) they just reissued the original letter to the right name and address and I got the 30 days to pay it.... ..got a nice picture of me laughing whilst doing it as well..!
