The House of Lords held that Melissa Miller can keep the £5 million she was awarded out of the £17.5 million fortune of her husband Alan and that Julia McFarlane is entitled to £250,000 a year from her husband Kenneth for life rather than just for five years as decided by the Court of Appeal. The judgment, which lays down guidelines for the courts on how to split the assets between partners in multi-million-pound settlements, has taken on added significance since the separation of Heather Mills McCartney and Sir Paul McCartney, whose personal wealth is said to exceed £820 million. Outside court Mrs McFarlane's lawyer James Pirrie said: "We are delighted for Julia. It is a ground-breaking ruling. Until today maintenance for a stay-at-home mum was based purely on her living costs. "Now judges must consider contribution and compensation for people like Julia. "This is only fair. The judgment recognises her sacrifice and that marriage is a partnership." Another member of Mrs McFarlane's legal team, Bradley Williams, said she was pleased with the outcome but disappointed that it had taken five years to get there with the consequential effects on her family life and children. He added that Mrs McFarlane had given up her promising career as a city solicitor in 1991 with her husband's agreement so she could bring up their children. During this time his earning levels accelerated with her support and by 2002 his total net income exceeded £750,000 a year. On leaving court Mrs Miller said: "Obviously I am very happy." There's nothing in the law that says the settlement should go either way. Today, two major things were up for landmark rulings: 1) That a spouse shouldn't automatically have a right to their former partner's future earnings. 2) That the grounds for divorce should not play a part in the settlement. The rulings effectively upheld this, rather then overturning them. So consequently its still absolutely legal to marry someone for their money, screw around and then file for divorce and walk away set up for life. If you marry someone then you share everything, whichever way it goes, I can't see the problem. Beign well off is jsut another quality like being good looking ro having a good personality or having certain hobbies or whatever when you are selecting a partner. They have a boring job and see babies as being more fun. I am talking about Swedish women here to be fair. The cases in the news are very extreme and I doubt will affect anyone in this forum who is unfortunate enough to have a breakdown in their marriage. When my wife bailed she didn't ask for a penny of my money and just packed up and left. There were no kids. I imagine that this is the more usual scenario. No its not about the sex at all. Whats mine is yours and whats yours in mine I agree with totally. But when women don't want to have sex thats it no sex regardles rigt? Fine, so when men don't want to share their fortune that they have accumilated through work or whatever that should be accepted too. Women use the case that they have been accustomed to the way of life that their other partner provided and should therefore carry on that way of life till someone else supports her or if she chooses to re-marry. So what about what the man has become acustomed to? What I am trying to get at is the relationship is over so why should there be any compensation if you choose to leave or if you are left. I agree the realtionship or marriage should have nothing to do with money. What is mine is yours and yours is mine but when its over what is yours is yours and what is mine is mine. Like how it was before you even met and got together. My wife and I eat out a lot and enjoy a good meal. We have become accustomed to eating at certain restaurants and get on very well with the owner. Now when we leave the restaurant they don't owe me anything. So should you leave your partner you should not have to owe then shit. That is equality and that is how it should be. Those laws are there to stop you from leaving your partner once married. More religeous and political than logical. IMO I think the point was that it doesn't matter which partner is rich to start with anymore ie it doesn't favour women.
