Somthing to do with the right to remain silent. Like Gazz said, they'll need to show proof. If they can prove both claims, you might be in big trouble. I will not elaborate further on a public forum, but it's certainly doable - I know first hand. If you are familiar with officialdom and paper shuffling then you can throw so many obstacles in their course as to make it uneconomical for them to continue pursuing the case. If they want to catch more 'criminals' then they should invest in more traffic police, who will stop offenders, verify personal details and take it from there. Automated fines through the post make my blood boil, that's why the roads are full of criminals driving around in cheap cars that cannot be flagged on ANPR or cannot be traced to a valid address. Yes, more *real* police officers on the road is what we want, not civilian camera opetors and fine-processing staff. Enough with the cheapskate mentality. Bob Posted April 29, 2006 Share Posted April 29, 2006 The notice of intended prosecution will tell you how you were caught, probably one of the smallish traffic light cameras that also read speed too (Sherlock Holmes eat your heart out, eh? ) Reply to the letter, politely requesting a copy of the photographic evidence along with a copy of the calibration certificate for that particular camera. Darren-K Posted April 29, 2006 Share Posted April 29, 2006 In my recent case ( which only a couple of members here knew about~) i bought my supra of someone near me ( a member from here ),. on her way to deliver the car she was snapped by a speed camera., i purchased the car litteraly 10 mins later,... over 5 months i got 2 speeding tickets and notice for prosecution letters,. plus others asking for more info etc,. thing is the person who sold me the car was convinced she would get off with it - and she did ( i think)., however i had 5 months of hassle because of it., last letter they sent me said they were taking me to court - that was about january- febuary and ive not heard anything since. i "might" be in the clear., good luck with your case mate Quote Link to comment Share on other sites More sharing options...

In order for them to prosecute you for failing to stop at a red light both front and rear wheels have to have gone over the white line after the light has already changed to red. As the registered keeper you have every right to demand to see the photographic evidence, especially if it will help refresh your memory as to who was actually driving at the time of the alleged offence. Do not allow to be bullied into admitting you were the driver if you are not 100% certain it was indeed you driving. Despite their fancy language and veiled threats the law demands that they have to prove the identity of the driver. The registered keeper only has to help as much as he can, but this can be open to interpretation --- people can be absent, forgetful etc. Don't be offended, but judging from your spelling it might be best to let someone else handle the corresponance with officials. A good start would be to read this post. To submit a PACE statement - copy the template into Word, add your details, print it and sign it. You should write 'Please see attached' (and nothing else) on your s.172 form. Staple the PACE WS to the s.172 and send the documents to The Chief Constable using RMSD, as detailed above. Submitting a PACE witness statement satisfies the statutory requirements of s.172 RTA 1988 of providing the driver details at the time of the alleged offence. It is not a cast-iron get out of jail free card and there may be a lot of research and swotting up for you to do in the future. The members here can and will provide guidance but, ultimately, it is down to you to decide which way to go and whether you want to put in the effort. The Pepipoo 'archives' are full of relevant laws and their interpretations (in English !) and previous cases. You have plenty of time before a response is required. ASK for as many details as you feel you need to have and do NOT give away anything specific if you don't have to. They play power games and most people fall for their tactics.
