A bit pissed

ok heres the story,

On the lexus forum (LOC) i bought a single turbo kit for my mk1 aristo from a certain trader there via ebay. I had asked this trader if they had a kit that would fit my mk1 aristo and they said yes they had one made up for one of their previous cars. A week later they put the kit on ebay and i won it. Now it has arrived i have had it checked out my my local garage and they have said it is NOT for an aristo but for the gs300 which is N/A. This was the N/A - turbo conversion kit. Now i wouldnt mind but i specifically said i have a jzs-147 aristo. The said trader wont refund me and now im left with this N/A kit with includes everything for the conversion including FMIC and and downpipe.

 

what should i do now? i still have the proof that i said i needed the kit for an aristo but they wont give me a refund.

 

by the way the kit would also fit a N/A supra which helps when it comes to sell it.

How did you pay for it? If it was with PayPal, I believe you can submit a complaint saying the goods are not "substantially as described". PayPal can freeze the seller's account, which is a good motivation for them to sort it out with you.

 

If you paid by credit card, just take it up with the credit card company.

Name and shame, post up your 'proof' on the lexus forums and publicy slag them off till they refund you (at the same time ebay it) :)

 

lol yeah i will do that when i have no other option, like i said i have a few buyers and hopefully it will be sold if not i will post up screen shots of my saved PMs from both myself and the trader.

Im sure this comes under the sale of goods act, something along the lines of being fit for the purpose

If he is a trader you have rights..refund or replacement.

The goods must be fit for the purpose they were purchased for. It's part of Trading Standards. Call your local office if you have probs, but don't leave it too long.

He has misrepresented the goods in order to sell them to you. That is not allowed...

i cant believe TDI were like that either tbh. I was told to get back to them in a week or so to see what they could do for me. I am very lucky the kit will fit a N/A or else i would be down about 1k. So people say they are good but i think they are rubbish, the customer service is poor in this case aand i'll never buy a thing off them again. Thankfully we have great traders on here.
