terribleturner Posted December 30, 2005 Share Posted December 30, 2005 Anybody know if i have a leg to stand on if the company pay our sister company 2.5 weeks for each year they have worked and then pay us 2 weeks for every year we've worked?? They do exactly the same thing as us and about a year ago they changed certain things so that we were both in line with the company (pay,hoilday etc....). John_M Posted December 30, 2005 Share Posted December 30, 2005 Minimum requirement to be paid out in redundancy (after two years worked) is one week basic money per year worked raising to 1.5 weeks per year for every year you've been over 40. for example: if you'd worked for a company for 5 years and were aged 43 you'd get 6.5 weeks money. How many people are being made redundant? Have you had your consultation period yet? Is the consultation being delt with by workforce representative, union representative or individually (over a certain amount of redundacies and a representative has to be elected by law)? I hope that you are a member of a union as this is where they pay off. Our recognition has just been approved by the CAC because the company was refusing to recognise the union but was too late for the consultation. However we've two claims going to tribunal at the moment. One for Insufficient consultation and another for unfair selection (for the guys actually made redundant). We've just had redundancies at our place and they paid out the minimum allowed which is typical of our company. I'm still in but we think that it's only going to be a temporary measure until April time when we feel that the company will be shutting down our distribution centre. I'm 27 so not goona make a difference, plus i don't think we have anyone over 40 being let go. How many people are being made redundant? About 50 from this place i reckon and about 70 odd from the other. Have you had your consultation period yet? We've just entered it. black cat Posted December 31, 2005 Share Posted December 31, 2005 sorry to here this mate. this happend to me 6 months ago after being with a company for 2 and a bit years, i got 2 weeks redundancy. which i thought fine although pissed right off. however they failed to tell me that the minimum was 260 quid per week that they had to pay me.... guess what??? i got the minimum not 1 weeks salary at all, not even close to a weeks salary ... :complain: not a leg to stand on. in fact i got more in 4 days holiday back pay. tt steve Link to comment Share on other sites More sharing options...
