supra joe Posted October 23, 2016 Share Posted October 23, 2016 Hi chaps.. Could do with some advice I was on my way to work last night when I was crossing a roundabout in the right hand lane. There was a corsa in the left hand lane indicating to pull on to the motorway and an Astra behind that. I began to indicate to pull over in to the left hand lane as it was clear and I was in the right lane. [ATTACH=CONFIG]215338[/ATTACH]Got half way across and this astra came past at about 40mph plus cutting me off and damaging his car and mine. (More damage to his) he tried to drive off and I managed to get infront to cut him off. I managed to get out of the car and as I did 2 males emerged and got aggressive immediately started swinging punches... As I was dealing with one the other ran to the car for his wheel brace and spent a good few minutes trying to hit me with it as his mate tried too. I took a hit to the hand and side of the head but managed to subdue him as best I could being two of them. I jury's aren't too bad.. Some bruising and swelling. Anyway as I had the driver his mate came in swinging to which I left go and had to focus on both of them again. The passenger ren around the car and tried to drive off.. I managed to reach through the car and grab the ignition keys as he was trying to pull out. Couldn't get the keys even after trying to bend his arm and get them. The driver then went to my car and tried to take it so I chased him and his mate ran off leaving their own car... Whit eases called the police and gave statements saying these guys came out swinging with the wheel brace and I was like a cat and she didn't know how I managed to avoid most of these hits lol. Another asian male came along and helped me big time by giving me their names Police have traced the owner of the car and the car is insured... But not to the lads driving it As its their mother she is claiming she didn't give him permission to drive it but will not report him for twoc. Both lads are now currently on the run, even their mother claims they are in Leeds... Which they are not. Just wondering if anyone knows where I would stand with making a claim ?! Many thanks. They'll be up for driving wihout insurance and leaving the scene of an accident, not to mention assault, even if their mother won't report them for taking without consent. The mother let them take it in which case she is liable or that she didn't allow them to which means they will get prosecuted. It doesn't matter if she reports them or not. supra joe Posted October 25, 2016 Author Share Posted October 25, 2016 Turns out the driver wasn't insured... His mam was but he wasn't. I rang a solicitor and they weren't interested in taking it on (Winn solicitors) even though they obviously sped up to cut me off when I was changing lanes. (Clear or not) so since she was the only one insured and he wasn't and he took the car without concent... Does that mean she can't claim against me because she wasn't involved ?? Ive been told im pretty screwed for claiming against him because he wasn't insured, hence why ive never reported it. It's sounding like it's just not worth the hassle ( my premiums go up and he gets away with it ) to make things worse I got an email through and I have to go back to the police station.
