uzzyuzzy Posted June 29, 2016 Share Posted June 29, 2016 My car was parked legally outside my mother’s home and it’s a dead end road. Kids are always playing football and riding their bikes up and down including those that do not live on this road. I knew a day would come when one of the cars on the road would get damaged and it happened to be mine. This kid who lives a fair 5 minutes walk from our road was riding his bike up and down and decided to do a wheelie and crashed into my car leaving a deep gash that is revealing the bare metal. I have got 2 quotes for the repair and have been told by both garages that this severe damage and if not fixed will rust in due course. I have been quoted 350-400 . The family accepted responsibility and said they would pay for the damage. I have shown them the quotes and now their refusing and saying go through your own insurance and when I showed my persistence they have said they know a mechanic who will fix it blah blah. It’s been 10 days and no progress so I would like to know what are my options? I really don’t want to go through my insurance as I have a big excess plus it will push my premium up next year. Scooter Posted June 29, 2016 Share Posted June 29, 2016 Easiest (note not most fair) way, ask what they are willing to pay their guy, take that and then add in the extra in it will cost to take it to where you feel comfortable they will do a good job, then move on. Luckily it was my daily driver and not the Supe. I did log this with the police and have a crime reference number but that's just for their bloody statistics. Fortunately, this only cost me a rally car remap to get fixed. I had a polish chap back into my GTR and had to suck that up as well. Stonkin Posted June 29, 2016 Share Posted June 29, 2016 Are there any witness's who saw the kid do the damage to your car? Can they provide a statement? The car should not be taken to the parents choice of garage just because they can obtain a cheaper quote. It's your car that is damaged, it is taken to a garage of your choice who you are happy with their standard of work. It is not a case of what they are willing to pay towards the bill. As long as the invoice you give to them is within reason to return the car to the standard pre accident, then that's the bill they pay, end of. None of the bill should come out of your pocket. The tone has changed all of a sudden, he has asked for few more days as there is hospital appointments etc etc. The annoying thing is the parents don't speak English and all going through the older brother who is the legal guardian. far Posted June 29, 2016 Share Posted June 29, 2016 I would use a strategic approach to ensure when you do get the solicitors involved they dont just deny it. You need them to admit liability and record it or at least get a witness. Maybe go round and say to them that your insurance company wants a picture of the childs bike that did the damage (ideally you might be able to get a close up of the damage to his bike if there is any) and when you take the picture ensure you are recording the conversation and their house is in the background. then hit them with the solicitors once you have the evidence as a back up in case they deny everything (in which case it will be very hard to prove) Quote Link to comment Share on other sites More sharing options...

A few more days for them to do more digging on how to get out of it? i wouldnt stop there, keep pushing. DONT BE THE NICE GUY in this at all or you will be at a loss.
