paulj1 Posted November 19, 2015 Share Posted November 19, 2015 Hi guys some help is needed I went to asda in Hull twice in one day once at 05:30 on way to work then went to work for 10 hour shift then went to get petrol on way home at about 16:15 weve got cctv at work as well as clock card times and manager is willing to write a statement for me as he saw me and my car there. Asda or smart parking on their behalf have fined me for been in the car park for 10 hours when I clearly wasn't how do I go about appealing this as the number on the fine just gives you option for paying the fine and asda aren't interested one bit Quote Link to comment Share on other sites More sharing options...

Its a private company and worst they can do is take you to court where you will present all the evidence that you haven done that and they will end up paying admin for courts etc. hence they will not even go to court if not 100% sure. That's a very extreme outcome and would require a few court hearings which I don't think will ever happen. As above, it is a private trespass matter. Speak to the store manager and see if they can get it cancelled. Failing that I would contest the parking charge and explain you have suitable evidence to support your account. Al Massey Posted November 19, 2015 Share Posted November 19, 2015 Mate, it happens all the time. The camera recorded you entering and leaving at different times. Simple mistake. But this is not a fine, if it says fine anywhere on the ticket it's illegal. They can only invoice you. And they will only go to court if they think they can win, which is non existent now.
