Al Massey
As above, I'm planning on taking an insurance company Ageas and the highways agency to court and claim damages. Does anyone know anyone who could help? Cheers
mattdavies
Why are you Sueing the Highways agency ? You do know the highways agency doesn't exist anymore and is now called highways England ?
Al Massey
Well it's Skanska that worked on behalf of the highway agency. Because they claimed I knocked over a lamppost on a dual carriageway, whilst not causing any damage to a car, then after a year of fighting it, my insurance company decided to pay out and not tell me about it. So now I've lost my no claims, and have to pay higher premiums on my insurance for both cars.
RobUK
Have you tried citizens advice or the insurance ombudsmen?
Chris Wilson
*ANY* solicitor would be only too happy to attempt to sue a large organisation, on your behalf. It'll be money (yours...) for old rope. They don't care you will probably have huge fees to front. Sounds a good way to go bust to me, unless you can get legal aid, which thankfully these days is much harder to get than it was when people were bringing specious claims against all and sundry at the taxpayers expense. The costs will rack up alarmingly, so unless you are 110% sure you'll win....
Al Massey
Well I didn't knock over a lamppost and to knock one over would cause considerable damage to a car and most likely right it off. So no chance I could of done it. Insurance ombudsman is my next step depending on the outcome of my complaint.
Burna
Did you actually have an impact with a lampost though? No matter how minor.
Chris Wilson
Disputing a claim or allegation is very different, legally and financially to suing them
ozz
Have you any idea how much it will cost to sue? And I'm pretty sure assuming you even won you can only sue for actual loss, which if just your no claims will be dwarfed by legal costs. I'd try a different tack - post on PH legal section for advice as I'm sure there was a way you could dispute liability with an insurer - resulting in a situation where they decide to settle a claim but you don't accept the penalty. To be honest I don't care. I'm sick of companies thinking they are too big and can get away with bully tactics. I'll be able to sue for my loss, and legal costs. There will be a way and I will find it. I've already started the dispute via several sources, and I will escalate things if they don't resolve the situation. The facts alone will destroy their case. Plus I've already emailed everyone that works for Skanska the whole situation, with facts and photos and my plans, and my complaints so someone there will be getting a bit annoyed and would want it sorted. supra matt
Maybe one of your cars has been cloned and it's that that has had the accident, but surely the police would of come knocking if you had knocked one over and as you say the car would have alot of damage,

Just no lamp post was knocked down and the car was fine. Police even let me go straight after. Well if they apologise, remove me from the CUE database then all will be fine

Plus it gives them a chance to say "Oh sorry, our mistake!" which is a lot easier to deal with "Oh a court summons"
JasonR24
Fair play to you Al, definitely stand up to them, unfortunately it is the way of the world that large companies bully people and do whatever they want. It disgusts me. Hopefully a letter from a solicitor will kick them into touch. If not then see what the solicitor says. If you've got pictures of the accident scene and there's no damage to any lamppost or your car then they don't have a leg to stand on! JayJay1374
I hit a lamppost at 60mph in one of my old cars (obviously not on purpose) and it barely marked it. You'd have to be going at some force driving a truck to even get near knocking one down. Good luck Al. Hope you get sorted.
