Fifty Posted August 10, 2005 Share Posted August 10, 2005 guess what, the little prick has now built a fence along the alley between our 2 houses, and now we cant park the second car cos he has deliberately placed it to screw the angles. I now have 2 cars parked on road :thumbdown what a tosser. There appears to be little I can do except write to council (I have the complaint form). Supragal Posted August 10, 2005 Share Posted August 10, 2005 i'd imagine that if it's their boundary then they can put a fence on it. i believe there is something about it not being over 1 metre tall?. similar thing here. if we wanted to be evil we could divide on our boundary and then the neighbours wouldnt be able to get onto their drive as we own the area where it joins the road... weird. Mike Posted August 10, 2005 Share Posted August 10, 2005 Not boundary law, but I do know if you make a complaint you have to declare it to your buyers if you sell... and if you don't and they find out (or have a disagreement themselves, which would presumably result in them finding out from the counsel).. they can come back and sue you... so it might be worth just moving house..!! My other half's sister is having similar problems after she found out the house next door is a half way house for offenders (she found out in the local paper that someone got raped there last week... so it's all going really well for her...) but if she complains, she won't sell the house, or she'll lose money... so she's decided to keep quiet... Faye Brother Posted August 10, 2005 Share Posted August 10, 2005 If it's on their land and it's not adjacent to a highway then you can normally erect a fence or other means of enclosure up to 2m in height without requiring planning permission. Assuming all the land in question is privately owned, the fence is not more than 2m high and there's no relevant restrictive planning conditions attached to the original property, I doubt your local council will be able to assist you. However, if you do contact them about the fence, bear in mind that house sellers are legally obliged to notify potential purchasers if they've had cause to complain about their neighbours.
