dr_jekyll
hi all, just after a bit of advice. ill cut to the chase. basicly the mrs dad had a shop that went under 2 years ago. he has since recived a very large bill for counsil tax on the property he was renting for the shop. now he handed the keys back and the landlord exepted them, thus taking away his access to the property. but the council is saying the bill his still his responsilbility even thoigh he doesnt own the property and hasnt been there for 2 years. i have spent many hours trying to explain this to the retards on the other end of the phone yet they have still snt bailifs to his home adress twice. can anybody shed some light on hwere we might stand if we take this to court for harrasment? Abz
I take it he handed the lease back to the owner? He would need to have proof to show that he no longer owned the property & the sign off date of when he handed the property back. Also receipts of the last council tax payment might be handy. Abz
hmm thats the problem , the landord has vanished from the face of the earth Does he have any documentation when he did hand back the keys to say he is giving the shop back? Like a deed of surrender or deed of consent to say that the lease is going back to the landlord & he is giving the property up? Basically he needs to prove the shop was no longer in his hands to sort this out. Unless he has documents it is going to be tricky.
