MaveriK Posted April 28, 2011 Share Posted April 28, 2011 I have just part exchanged my house with Charles Church, a value was agreed by three seperate estate agents for my property and we agreed figures and shook hands. Part of the insentive was £500 cash back to help with moving/legal fees, they have now turned this around and the £500 was a clean and tidy clause on my old property which they are refusing now to pay out. I will admit that i did not hover the floors and that there was a empty box on the floor, a pile of magazines and a few odds and ends. I was under the impression that i had to be out of my house by 2pm and once out could not reenter as it was no longer my property. Also the weather on the 20th december was horrid and everything took longer. It turns out they have gutted the inside of it and put in new carpets and painted everything. Surely that is not my concern as the valuation would have taken the state of the carpets etc into account? Obviously they are refusing to payout, probably because i beat 20k off the price of the new home, but £500 is going to come in very handy (isnt it Paul Whiffin!!!) Is it worth pursuing or am i on a loser and should just hitch my frock up and take it? Very fecked off about it! Quote Link to comment Share on other sites More sharing options...

I used to act for developers and normally they are quite good at giving the 'clean and tidy' £500 back at the time of completion - but it sounds like they've done a lot more to the property since you left it. I would check the contract as Charlotte said and see if it's affected by the 'clean and tidy' - it's all dependant on how 'clean and tidy' they deem the house to be when they go and see it after you've moved I think. Well - they obviously deemed the carpets knackered and opted to use the money to replace - or to pay for fitting, I'm really not sure.
