mwilkinson Posted March 30, 2011 Share Posted March 30, 2011 The gentleman would have been subject to a £30 non-endrsable fixed penalty notice. His legal advice was a little duff. Whilst under a stop and search you are not required to give your name and address, for the reporting of an offence general arrest conditions apply under section 24 PACE 1984. As such his refusal to provide his name and address would have meant I would have arrested him for being unable to establish who his is and where he lives which makes it impossible to issue the ticket. I might also have considered seizing the camera under section 19 PACE 1984 as evidence of his failure to provide details. If he tried to cycle off I would have further arrested him for obstruction. I was threatened arrest for not having any details on me before whilst I just left my house driving a car registered to me etc. The traffic officer kept me on the side of the road for 40 mins and the reason he tugged me was because of my lack of front numberplate , which when I showed him it was there on my front bumper where it belonged he was embarrassed but then actually said I might have been a terrorist because he did see my numberplate ???? He should have been more firm and they were some quite basic challenges put forward by the male stopped. Like I said just tell him he does not have to provide his name and address and he does have the right to silence but it will mean he will be taking a trip down to the local station in a police van. They are human beings too who should respect the law as much as the next person. I've known many scenarios where the police were in the wrong. There are some nice officers out there, but there are too many who take things way too far against innocent people or people who have only done something silly and simply need a telling off. I'll give you an example of why, an actual live in example that I experienced..... Many many moons ago I was out in the town with my girlfriend. We had a brilliant night and it was time to head home, rather than pay the expensive taxi rates we decided to get a bus (she was used to getting the bus from there as she was local) so we headed off to the stop. Once there we noticed there were a couple of cops standing around 20ft from the bus stop. They were clearly there patrolling in order to try and keep the peace at night time. I was quite happy to see them there, showing an effort from the forces etc, and it was also good as we felt much more secure sitting waiting on the bus. After 10 mins or so a rowdy crowd of around 15 guys came round the corner. They were on the opposite side of the road making their way to another part of town. They were shouting, and singing etc, you know the usual. They were extremely loud and swearing but not really causing any hassle so I guessed, at the time, that was why the officers had just let them carry on. FFWD another 10 mins and my phone goes, it is a mate who we were in the town with. The usual drunken conversation followed with the "where are you" etc. I was fairly drunk and my voice had amplified a fair bit on the phone. No swearing and nothing untoward said on the phone. 30 seconds into the conversation one of the officers approached me and asked me to hang up the phone. I told my mate I would phone him back and asked the officer what the problem was. Apparently I was being extremely loud and a nuisance to the public, I had a brisk look over each shoulder to see noone, we were directly outside a mcdonalds in one of the shopping areas in glasgow. I told him exactly what I thought of him and my Girlfriend was going nuts, at this point his collegue came over and asked him to leave. His colleague then said I shouldn't speak to police that way, I calmly then spoke to the guy and gave him my side of the story. I think he accepted it as nothing else was said and away they went. In my opinion a lot of the Police in Britain don't have the backbone to deal with the real issues that neighbourhoods are faced with nowadays. That situation felt to me like the guy got frustrated at his own cowardess so he decided to take it out on me. My respect for the boys in blue dropped a fair few points that night. Always take the good with the bad though. The dwindling numbers means that the good guys as well as the not so good guys are getting a far harder task to do. Yes but Matt I feel you would have been able to answer the guys question slighty better. The pc came over as a bit of a tool imo as he seemed completley out of his depth and very flustered. I thought it was quite funny especially when the documents were being mentioned several times !!!!! I took it that the guy only wanted to be told the law verbattum so he could make a decision as to wether he had to give his name etc by law, I don't think that up to that point he had in fact broken the law, the pc should not have put hands on him as he was at that time not under arrest, there again you would not have been cycling around looking like a member of the tufty club!!! Why would you have respect for someone who approaches with the attitude of that officer ???? Take the uniform off him and you would call him an arogant git. respect is earnt.......on both sides, I was stopped in a customers Supra by traffic for tinted windows on tuesday, he had the VOSA man with him who was cock, the traffic officer was absolutley proffesional and credit to the force, very quickly we were at ease with each other as the VOSA guy goes round the car, the cop even agreed the tint seemed OK but if VOSA say no its not then it has to come off, which it did. Shook hands with the cop and he left saying he would pop into the shop as he's into fast cars. he was everything I expect a policeman to be. Polite, courtious and proffesional, as I was to him. Abz Posted March 31, 2011 Share Posted March 31, 2011 I have used to get pulled over a lot when I was younger, used to love the good cop, bad cop roles, used to crack me up. End of the day they are human, some will use body language & tone of voice to intimidate you, it is part of their training to control the situation. Some people take this in the way wrong, I have seen this loads of times with friends. I have only really got annoyed with a police officer once or twice and it was purely because the person himself was rude and arrogant, generally though they are fine if you are too. I have got away with a lot of things which I should have been charged with, speeding etc, but as on most occasions it was late at night & with being honest they just let me off. Let's just hope that his 'kid(s)' that he was claiming to be off to school to pick up on his bike (great excuse for running a red) won't be sat in a child seat on the back at the time. This guy has really impoved the over all image of cyclists, really he has, what a stand up guy, way cool, stick it to the man, Danny you're awesome!!! ps.
