Can you still get points if your not pulled over?

As per title, a friend asked me if he would still get points for speeding, even if he wasnt pulled over. It was a policeman standing on a fly over with a gun, he was definately over the speed limit and the policeman definately pointed the gun at him (and others infront) but he didnt get pulled over. I dont think it was out the back of a police van, the way he descibed it the policeman was just stood there with the gun watching the traffic.

If it is a radar gun (which it sounds like), then they need to pull you over.

 

The camera's from the back of the vans don't though as they have the photograhpic evidence.

 

Tell him to wait 14 days, if he has nothing in through the post, then his fine.

 

I think the letter he should be worried about is called a NIP (Must be served within 14 days).

As stated above if nothing is heard in the next two weeks then the likely hood that you got away with it increases dramatically.

 

The first thing that would come through the post is the NIP - Notice of Intended Prosecution - which would require the registered keeper of the vehicle to identify the driver at the stated time and date. This is a legal requirement, so if you stated that you didn't know or would not disclose such information then you would be charged under s172 RTA. By stating you were the driver a case would be forwarded to the area fiscal who would decide whether to take up the prosecution (this is based on pre agreed percentages over the limit and are different in each area). If they did then you would receive a copy complaint outlining the offence and whether you wished to plead guilty or not. Not = Going to Court. Guilty = license endorsed accordingly.

If it was at acle then the 2 coppers there are more interested in catching people with radar jammers. They seem to get more cash than just speeding. Not that is why they would do it of course. About time the limits in certain places at certain times was increased anyway.

Time to build a stelth car with radar absorbing materials and dispersive surfaces, then you wont need a jammer.

Or just paint your car black, remove all distintive features and drive as fast as you want and just make sure they don't catch you. Just like Ghostrider :cool:

are you implying that you may have gone a couple of mph over the legal limit? surely not.

in these circumstance, dont the guys on the bridge have a support car on the motorway so they can then tug you once they radio through?

That is normally how they do it, yes.
