Paul372 Posted January 14, 2011 Share Posted January 14, 2011 I hit a pot hole in the supe wednesday night, i didn't see it untill it was to late. It wreck my tyre, knock the tracking out and has dented my blitz nur spec exhaust. Has anyone claim of the council for damage cause by pot holes to there cars and have you had any luck with your claim. I ve phone the council up and got told to phone kent high ways which i did. The lady on the phone was very helpful and understanding, gave her all my details and said i had pictures and measurements of the pot hole etc, she said they will send me a claim form and that they will send someone out to investigate the pot hole. just wondering really has anyone had any luck with this sort of claim or any tips that can help me with my claim, thanks Quote Link to comment Share on other sites More sharing options...

Rob Posted January 14, 2011 Share Posted January 14, 2011 The upshot is, if it has already been reported (presumably a day before as they can't be expected to come out in 5mins of a phone call) and not repaired when you hit it, you have a good chance with your claim. Paul Posted January 14, 2011 Share Posted January 14, 2011 Go to http://www.fixmystreet.com and find one locally that's been reported a few days, pop out and check it's still not repaired then take pics of that one rather than the actual one you went down. bluecoup Posted January 14, 2011 Share Posted January 14, 2011 you have to prove they didn't know about the pothole and where negligent, so you have to take pictures, i took a bit of dowel with inch markings on it, fill out the eight page claim form and send it off, they will then say they didn't know about it, so you have to ask for copys of there records under the freedom of infomation act, which of course they charge you a admin charge for think it was something like £2.50 per page when we asked and if its not been reported before you did, you get nothing except more outlay, slim chance, you might get lucky though Quote Link to comment Share on other sites More sharing options...

I've got two buckled wheels and a car i can't drive because I'm out of work and cant afford to get it properly inspected up front. I have the details for derbyshire councils insurance dept so there is hope. I'm gonna guess it is individual councils that you contend with and some will be harder than others. ripped_fear Posted January 26, 2011 Share Posted January 26, 2011 hey mate best of luck you are going to need it, on my last car exactly the same thing happened they were very helpful got my claims form and then after a cple of weeks I got a big F@CK you! the whole nakered my alloy, tacking shot, tore tire, broke a weld in exhaust and the hole was about 3foot across by 4foot and about 1 to 2inchs deep and they said it was not their fault as some guy had check the road two months before hand. all I can say is good luck mate and I hope your concil is better than the isle of wight lot! :@ Quote Link to comment Share on other sites More sharing options...
