trinitom Posted October 9, 2010 Share Posted October 9, 2010 yesterday night i was with a few friends when this drunk guy on he's 20's came to us asking about racing and food lol. after a while i saw this same guy going in to car, and i did think to my self.. this guy surely wont drive. but actualy he did. as i think drink and drive is a big NO NO, i did phone the police and give the details on the car and driver. i think i have done the right thing. If there is evidence to state that he intends to drive the vehicle home and is in possession of the keys to the vehicle then he can be arrested under section 5 of the Road Traffic Act. Furthermore if he is so drunk he is deemed incapable he can be arrested under section 4 of the road Traffic Act and the police don't require a road side breath test. I have recently been to court for a chap I arrested for drunk in charge in Soho, London. He tried going not guilty but lost the case. The Magistrate gave him a 12 month disqualification, £1000 fine and he has to attend a rehabilitation course. You did the right thing. When I was in the Police I had a similar incident where a pissed bloke had been locked out of his house by his irate wife and he decided to sleep in the back seat of his Ford fiesta. He had the keys in his pocket but my colleague decided to arrest him even though I believed there was little chance of him drink driving...... This is one of the reasons I jacked because of pricks like him. What the guy had done, was nothing different to me a couple of years before..!! H.
