Well, if you can done for eating an apple (as per the recent court case) then I am sure that using these whilst driving is illegal too. Two way radio's are specifically exempt from the new law - otherwise the police or other emergency services wouldn't be able to use a radio whilst driving. "Two-way radios can still be used, but only if the radio cannot also function as a mobile phone. Using a dual function radio/phone is illegal even when only the radio function of the device is used." If the radio is hand held, you are not exempt.The broach must either be attached to the radio which must be securely fastened or on a wire/leash microphone attached to a car based device such as an R/T set.
