UK Employment Law - On Call Cover

Hey All,

 

I know there are many warps of life on this forum so thought I would run something by you all. Myself and others in the team work 0900-1730 Mon-Fri as a normal day but then have an on-call rota which means we are on on-call from 1730-0900 Mon-Fri and all of Sat and Sun, ie 48hours on call, this is one week on one week off.

 

We are paid an on-call allowance and then get overtime for each call we receive with min hour claimed but are expected to complete our normal working hours Mon-Fri.

 

Some days we have no calls and other days we may get 2 hours broken sleep through the night while dealing with out of hours work.

 

How does this work with UK Employment Law which states that all employees are entitled to an 11 hour rest period in 24hrs?

not sure bud but when i worked at leeds commercials i was on call for a week at a time and i got calls out at stupid o clock but had to be at work at 8am.. but i got so pissed off with it that i went to citizens advice.. so i would go there mate....

It depends on your contract, being on call i'm sure doesnt effect you having to be in for your working shift.

 

As the 11 hour rest period is between your hours of work...i.e a 7hour day.

 

I do exactly the same on call as you.

 

mon - fri 5pm - 9am

sat & sunday whole time

 

and i expect there is alot of companies that do it as well, so i doubt it breaks any laws im afraid.

Ditto, it's not impacted, the 11 hours is counted outside of your core hours.

 

Hope your workplace is flexible or allows working from home though? if I'm up 12-5am on a weekday I'm not expected in the office and can just log in sometime and do my job, there's got to be some common sense involved.

 

Saying that they haven't adjusted our callout payment rates since 2005 :(

Yup, same here... I'm on-call as are a few of my guys, but my view is, if you have done a late night due to a call, let me know (same with the ops guy), and someone else will cover the working day. Being realistic you don't want tired people working because they make more mistakes, common sense and a bit of flexibility I reckon.

I do on-call for another department to keep my hand in and don't get any kind of relief the next day if I'm up all night. I have worked through until 4:30am in the past after a 6am start the previous day and I'm still expected in the office at 8:30am. I'm not formally contracted for it though so maybe that lets them get away with it, on the flipside I guess it also means I could just refuse but the money is nice when you get those weeks where you are just paid to sleep.

 

Out of interest what sort of stand-by rates do you folks get?

aren't working hours defined by your availibility to be at the desposal of your employer, therefore covering on-call. Certainly in my role I am unable to go about my normal life while covering, the difference is that I am not sat at my desk.
