Legal Question??

Just changed my Broadband provider from Plusnet to Virgin. My original terms and conditions state that I must give them at least 10 days notice to cancel my contract with them and no mention of charges to cancel my agreement.

 

Plusnet are now saying that I must pay them £25 ceasation charge. I asked them where they get this charge from and they say that they introduced it in October 2009. They claim that they e-mailed my old work e-mail but I left the company in August. They say that it is my responsibility to keep them informed of my e-mail address even though I have not had my own computer since losing my job.

 

They are now saying that if I do not pay, they will turn the debt over to a debt collection company and they will add their costs to the bill.

 

I am going to ring the CAB tomorrow but surely they cannot hide behind an e-mail?? They had my home address and current home phone number too..!! I don't mind the £25 but I think they are taking the piss with their methods of notification.....:blink:

 

Anyone else had this??

Legally they need to contact you by post (If address is avaliable) of changes to terms & conditions or incurring charges. Problem is they have sent out a form of notification which sometimes addicate enough so it can be a grey area. CAB would be best to advise on this bu don't keep your hopes high!

The really ironic thing is that you could have rejected their change of T&Cs and thereby ended your contract with them. I did exactly this to get out of a BT Broadband contract I no longer wanted to be tied to. They changed some small detail in the T&Cs and I used that as my reason to end the contract.

I didn't know that they had changed their T&C's though Jake. I only found out when I cancelled my contract and gave them notice..!! I didn't get time to ring the CAB today but I'll ask them tomorrow all being well..!!

You would need to check the terms and conditions to see if it is your responsibility to notify them of changes. I expect it is.

 

I would like to know how they know they sent it to your old email address if their records only go back to January 2010.

 

For £25 is it really worth fighting them. Even if you win the debt collectors will be a pain in the ass. I'd pay it and walk away or pay it and then kick off.
