clarky666 Posted April 15, 2010 Share Posted April 15, 2010 Looking for some assistance if possible regarding this. Boss is heading off on maternity leave for 10 months in a few weeks. Temporary secondment has opened up for her post recently for internal applications. Six of my colleagues went for it with interviews all done in one day, however one of them is currently abroad on holiday and was penciled in for an interview when they return. Interviews were done on Monday for the remaining five people however today it was announced that they've decided who's got it and officially offered them the post. This obviously leaves #6 strung up high and dry without getting an interview they were scheduled to attend and a nasty surprise when they return. Apparently they management "couldn't afford to hang around and had to make a quick decision". Can this be challenged and is it legal ? This can be challenged and if I was candidate 6 I would raise a grievance when I returned from hols, i would not be at all happy and actually felt I was being discriminated against. Not sure what size of company you work for and what the policies are. What 'management' need to be 100% sure of is if candidate 6 takes them to a tribunal what facts do they have to support their decision in excluding candidate 6 especially if an interview had already been pencilled in!
