Scams, Claims and Compo Games

Did anyone see this programme last night? I missed it but from I read in a TV review I'm almost glad that I did. It would have saved the TV from having something thrown at it. Few subjects make my blood boil as much as this one.

 

I'd like to hear from any people in the legal profession on here who watched it, what they thought of it. Not to bash them for working in a related profession, that's petty, tiresome and frankly goes nowhere. I'd like to know if they thought it was a fair indication of what goes on.

Yup, I saw it. Sad, but interesting none the less. The kid getting £ 2500 from his primary school for stubbing his toe playing footie at break time was particularly annoying. Our money too.

Cases like these usually result in schools banning certain activities altogether, e.g. no football at breaktimes. Schools don't have the spare cash to pay claims like these (even if they're insured against it which they may well be, the premiums would probably go up). It only makes things safer in that it gradually abolishes activities that can potentially cause an injury, thus making society more and more sterile.

thats what the school should do , and they should tell the rest of the school why fun has been banned and whos fault it is.

I was fuming at this last night too! The smugness of the family of the broken toe kid made me want to make them the stars of Saw 7! The branch falling out the tree was annoying too. As the investigating guy said, how can you inspect each branch of 80000 trees in the council borough in case one of them's undergoing natural processes and might fall. Actually, i was hit by a leaf the other day, might sue.. :rolleyes:

As someone with no kids, this is why I'm quite happy when it snows and all the schools gets closed causing trouble for parents having to be off work to supervise their own kids. I feel its claim- happy parents who have made their own bed, so to speak and now they have to lay in it.

 

As an architect I have to produce Designer's Risk Assessments for the buildings I make, for both the contractors building it, and the people who use it afterwards. If the building is over 2 metres high (outside of the Shire) I have to identify this startling fact to clear myself of any risk of legal action if a builder falls off the scaffolding, or if a window cleaner has to actually use a ladder to get to the bits above 2 metres.

It doesn't stop us designing things, but its just stupid paperwork stating the obvious in case someone falls out of a window and tries to blame me for designing a tall building.

Haha I agree. Absolutely ridiculous.

 

On the opposite side of the spectrum though, my dad told me that when he was in Pakland, a long time ago when he was a junior doctor, he had a patient who's penis was infected. The condition was potentially life threatening but the patient refused to go ahead with the operation to remove his little man.

 

Obviously his consent was needed to carry out the operation. So what the lead surgeon did was to put the guy under anaesthesia and forge his signature by way if getting the patient's thumb and dipping it in ink and stamping a document. Some people in villages are illiterate so this is their way of signing contracts.

 

Well my dad said the guy was less than pleased to find that he was penis-less (if such a word exists). No compensation available there!

They chose the scum of the earth solicitors and their most dodgy of clients.

 

It won't surprise people to find out that all reputable law firms are not like that.

 

They didn't even try to give a fair view and show the real claims with serious injuries that decent PI solicitors really make the difference .

 

As for an arguement, if anyone wants to see how one of the best PI law firms works I will happily show them around my offices or direct you to our success stories in the media

It won't surprise people to find out that all reputable law firms are not like that.

 

They didn't even try to give a fair view and show the real claims with serious injuries that decent PI solicitors really make the difference (I could tell you about some claims in Schools where you guys would be up in arms against the school for the disgusting failings they have done).

Yeah this. You really have to take documentaries like that with a pinch of salt. The media has its own agenda and it enhances this via shock-tactics and resorting to extremes and fooling the viewer into assuming that the latter represents the norm.

I'm kind of glad the documentary was distorted. Still a shame that such cases exist at all though.

 

I wonder if those cases set a legal precedent that then gets followed when other claimnants make a claim, rather like a floodgate.

Well it's all a bit more complicated than that. To bring a claim in the first place you have to be allowed to bring a claim by law. There isn't a precedent created since the case was allowed to be brought in the first place. The value of the claim has to be over the small claims limit to make a solicitor want to be involved too since we likely won't get paid otherwise.

 

When the media were blasting PI firms for claiming money off the NHS for negligence claims apparently the number of potential negligence claim enquires shot up as people were made aware they could claim. Programmes like last Thursdays may make certain people try it on with daft claims but I would hope the reputable firms would not be interested in taking them on.
