Anyway of dodging speed ticket points?

Hi all,

 

Mate of mine has recently come over from the US and got his uk license about 3 months ago. Got himself a speeding ticket with 3 points for doing 36mph in a 30 zone. Since he's new from the US with his 1st uk license he's been told if he gets 6 points he may face suspension, can someone confirm? Also he's asking me if there's any glitch in the system whereby he can dodge the points?

 

PS. He's a bmw driver :D

yes there are one or two of those.

 

UK law (as it stands) doesn't assume that the registered keeper was also the driver at the time of the offence.

The 'enforcement' authorities like to pretend so, but now you know.

So the onus is on the authorities to prove this, if they so wish. :cool:

 

 

The registered keeper should, however, help the authorities identify the driver at the time of the offence --- whether they will be successfull or not will depend on their ingenuity, determination and willingness to tie up resources. ;)

 

If he choses to follow that route (i.e. mate was driving) tell him to very careful with his wording if he writes anything, or if he talks to anyone. Give as little info as possible, while still appearing to be trying to help.

And FFS don't use the name of someone who needs a passport stamp (or airline ticket) to enter the UK ;)

Two or more potential names are even better.

 

The above assumes that he was not stopped at the roadside and had his identity verified (of course). Therefore a clear front-facing picture would be essential for the registered keeper in order to be able to tell who exactly it was. Usually such pictures are not available, and their response is one of empty threats and official bullying.

However, in the eyes of the Law, the registered keeper has done his bit, and the 'enforcement' authorities have the ball at that stage.

 

To recoup: the registered keeper can be very laconic and unwilling to sign/fill any forms unless evidence is made available to him/her of adequate quality so as to avoid incriminating innocent parties (which is unlawful in itself)

Hey thanks for all the replies everyone.

 

I've suggested he trade his 325i in for a moped but he's not having any of it + he won't fork out for a road angel.

 

Anyway he's also received a £60 fine, he's heard that if he sends a payment for more than this he'll be owed a refund, apparently this is a glitch in the system because the refund for the difference is never made & hence the file stays open and he won't receive the points? I heard about this one quite a few years back so surely they're on top of this one?

old hat I'm afraid, this might have been an urban myth as well.

These revenue collectors are not stupid you know. :sly:

Yeah, I guess I could do the same with mine, lol...

 

This guy has spelling mistakes on his eBay text though, personally I wouldn't trust someone who cannot spell properly for something that needs acumen and wordsmithing skills.
