They court are prosecuting 2 tour company employees and also staff of the hotel / complex where the children tragically died. Do you think that is right? Should a tour company employee be held responsible for the actions of a hotel / complex they have put guests in? Were they negligent in their duty of care to the family? pistonbroke Posted February 4, 2010 Share Posted February 4, 2010 It's a tough one for sure, though I'm not clued up on greek law so I don't know the tests applied for prosecuting cases. If the young company reps have been charged with manslaughter, I can only summise that they have specified somewhere that as part of the holiday package (small print) that certain safety guidelines, ie the corgi certified gas fittings have been adhered to, when in truth they have not. The hotel owner is a no brainer, but the tour operator shares the burden of responsibility simply for gaining financial reward from their clients who pay to stay there. Unless the reps are contractually responsible for checking safety in the hotel, and failed in that duty, I cant see how they can be held responsible...maybe Greek law is different in that respect...surely the responsibility rolls up toward the tour operator bosses. Thats the way I see it too my friend. I'm not sure about Greek law per se - if it is anything like most other bureaucratic aspects of the country then it will be heavily flawed. I have just done a course on my personal accountability and the truth is I could be in court on numerous technicalities even if my involvement was just signing off safe and legal books.
