It's totally normal practice, as they are such bad drivers it's unreal. I know, I've been there! Shame about your penalty though. Were there any witnesses to say that you weren't the only one tooting? Well as i said there was a queue of traffic behind me, but i did'nt take any reg numbers.So i have no way of contacting them Appeal it or have you signed to say you have accepted it, if more peeps stopped taking it up the arse from these pricks then we would not be in this state, he was obviously pissed because you have a nicer car than he OWNS thats why you see the traffic tossers get so excited on the TV programs when the desk sarge lets them take out a nice car on patrol!!!!!!!! This is the problem i have.I made the mistake of signing the paperwork. This is your problem, if you were a complete w**ker who spunged off the state and robbed/raped old ladies for your next fix you prob would have got a holiday instead I could'nt agree with you more mate.The system stinks!! formatzero Posted December 30, 2009 Share Posted December 30, 2009 Not surprised at all by this treatment your fatal mistake was to be a motorist.The trouble with some cops is they think because they have a uniform on they know everything about everything.I was stopped in my Accord by two young traffic cops( with the trendy gelled up hair) for an underinflated back tyre(i had my band gear in the boot and back seat).They said i couldn't continue unless i put the spare on.I said i didn't want to jack the car with the weight in it and couldn't take the gear out as it was pissing down.i offered to go and get my works van and move the gear into that, this idea was rejected.In their wisdom they told me to move gear from boot to front seats and jack the car.You see they were determined to see the condition of the spare(which was perfect).Despite my protests the car was jacked up and wheel taken off and bugger me one of them knelt down grabbed the spare to help me put it on. As we did the jack snapped and he nearly lost his hand between the wheel and arch.After that it was yes sir no sir what garage can we take you to sir anything to get them out of their ballsed up decision. Courts see bobbys on trips all the time. not all of them are cocks, they are after all human so you will find those odd bad apples and they need to be sorted out. As far as i am aware this cannot be challanged at court at this time S59 won't take you to Court - you're not being prosecuted. garethr Posted December 30, 2009 Share Posted December 30, 2009 It does seem a tad harsh to receive a Sec 59 for misuse of the horn when a verbal warning could have sufficed but two sides to a story and all that. You could complain by phoning and speaking to the Duty Officer who should be objective and try and seek a resolution for you. However as pointed out,using a horn whilst stationary is an offence but having a sec59 hanging over you for 12 months is a bit ott and not quite what the legislation was intended for. You can say that again! The legislation says the vehicle must be being used "...in a manner which— (a) contravenes section 3 or 34 of the Road Traffic Act 1988 (c. 52) (careless and inconsiderate driving and prohibition of off-road driving), and (b) is causing, or is likely to cause, alarm, distress or annoyance to members of the public...". Would sounding a car horn lead to a driver being prosecuted for careless and inconsiderate driving? The law says that the Section 59 can only be issued if the police officer "has reasonable grounds for believing that a motor vehicle is being used on any occasion in a manner which— (a) contravenes section 3 or 34 of the Road Traffic Act 1988 (c. 52) (careless and inconsiderate driving and prohibition of off-road driving)....". Presumably that means that if the S59 is refused the police person would have to issue a ticket for careless driving. Sounding horn = careless driving? I would have thought that any half-competent solicitor could demolish that case... if it ever saw the inside of a court. snake Posted December 30, 2009 Share Posted December 30, 2009 i have "beeped' my horn a few times when in stationary traffic ,on one occasion it was to warn a woman who was crossing the road pushing a pram.She was just about to go between two cars when i could see some twat riding his bike at full speed up the inside of the stationary cars, a few toots on the horn avoided a really bad day.Now it appears if mr plod had seen/heard me i could have had a bad day. The s59 stays with the DRIVER and the VEHICLE for 12 months, so the below quote would mean you still have the section attatched to your person...... You just have to close your eyes and take it like a man.... I think I am one of the people on the forum who has been pulled over the most, well in my young years of driving a fully modified orange EG civic. They most likely thought I was a little brat with an attitude. Was pretty surprised to find although I had the trade mark gangster jeans & clothes & 50 pence on my 12" dual bitch box I was actually a well spoken asian boy working for Deloitte. Some of them were idiots & would try as much as they could to scare me into thinking they were above the law, though I've studied pretty well what I can & I can not have (blame it on Clubcivic.com), as stateside they are even more stricter. They do stereotype & it could be due to seeing your car they assumed all the racket from all the cars had come from yourself (clearly it hadn't). I'd write a letter of complaint and advise at the local station. As mentioned above not sure if this would be able to go to court as it is not actually an offence. I bet I have been pulled over more times than you (for no reason either). Think about 20 times in 8 years of driving (never been given points on one occasion - says something about them doesn't it). 106 - assumed drug dealer rx7 - assumed drug dealer/stolen car - [red hot car to be pulled] supra - assumed money laundering/stolen car Amazingly lexus and laguna I never got pulled over. I guess they are not cars theives or a stereotypically big 6'3 black guy would drive. Nice you have an upbeat attitude about them. I think the opposite of them; though I agree some are decent, most in my opinion are not. Like you I am well educated and work for a prestigious city firm and they are very shocked when I speak and they realise I am well spoken.
