Hoppy Posted December 30, 2009 Share Posted December 30, 2009 I got nailed by the plod today at approximately 16.30 this aftrenoon I was sitting in my car at a junction near my home, waiting behind a single car in front.With a queue of traffic building up behind me. We were all waiting behind this car for well over a min, who was stopped at this junction for no apparent reason.There was no traffic passing on the road in front of us, but for some reason this ass in front was'nt pulling out. So i started to hear a few people tooting their horns, so i tooted my horn purely to let the car in front know that there was a fairly large queue of traffic behind them and basically to get a move on. Next thing i know, out of nowhere a traffic cop pulled up beside me and told me to pull over at the next safe spot. So i pulled over as instucted, and the copper walked up to my drivers windows and asked me to accompany him in the squad car. Next thing i know he was saying how i was being a nuisance to society, and that people like me were the cause of road rage and so on. "I politely tooted my horn for god sake, and thats it"!! This was followed by him checking my details, insurance, mot etc.He then started showing his authority by going on about how he could summons me to court on a due care and attention charge. So naturally i tried to defend myself by stating that i was not the only driver tooting my horn, and that the car in front was genuinely holding up the queue of traffic for no reason, but he was having none of it. The end result of this was me getting nailed with Section 59, which for those of you who don't already know means.If i get pulled over again within the next 12 months for playing my music to loud, wheel spinning, or even "TOOTING MY HORN" i will have my car taken off me. Bottom line is, i work, i pay my taxes, i don't street race, i don't commit rape or murder and i have always seen myself as a law abiding citizen.But they still manage to nail me for beeping my horn. Do we live in a total nanny state or wha?? i think it's f**cking pathetic.Motorists are easy pickings these days, and us motorists don't stand a chance. I know we'll never see a honest government in power.But is it to much to hope for, that one day we may actually see a government in power which actually has a pair of balls and a working brain cell!! Chances are though that you will not find another one willing to issue a 59. Don't chance it though now you have been given a PRA 59 because you won't get your car back, it will be crushed. Lbm Posted December 30, 2009 Share Posted December 30, 2009 That does sound unlucky, however I did get caught out in the Summer for driving without an MOT in the Supe - completely my fault, however the pc dealt with the offence with discretion. He was polite and we chatted about high powered cars for a bit and then off I drove - Even though I was given a producer, it all seemed to go away in the end So while this probably doesn't cheer you up at all, it does me Sorry. Courts see bobbys on trips all the time. Totally agree. It's a pain in the arse for you to have to do it but i'd have to appeal against that. Not always I used to think that but recently I got a fixed penalty for parking too close to a pedestrian crossing (even though it wasn't visible due to snow/slush) and I was more than polite with the officers in question to cut it short I was legal to drive the car was legal to drive and a warning would have been sufficient. I know coppers are human but they should exercise respect and make allowances for 'minor' offences which only require a civil discussion of what you may have done wrong folowed by a warning. If they have a bad day it doesn't give them the right to abuse their powers to the fullest extent of the law. IMO all coppers are different but the vast majority are no more than glorified bouncers who exert their powers too eagerly especially to the motoring citizen normally after they have breathalised you (you pass it) and haven't got anything major to convict you with. Ok i said my part, but i was polite in my response and did not give him any attitude.I'm proud with myself actually, cause he really pissed me off!! I would suggest using it inthe manner you described was exactly that, you were making the stationary driver aware of your, and others, presence. How come every fecking minicab driver isn't fined on every pick-up from a house? That's a nuisance and has no bearing on other road users. Class One Posted December 30, 2009 Share Posted December 30, 2009 It does seem a tad harsh to receive a Sec 59 for misuse of the horn when a verbal warningcould have sufficed but two sides to a story and all that. You could complain by phoning and speakIng to the Duty Officer who should be objective and try and seek a resolution for you. However as pointed out,using a horn whilst stationary is an offence but having a sec59 hanging over you for 12 months is a bit ott and not quite what the legislation was intended for. It's totally normal practice, as they are such bad drivers it's unreal. I know, I've been there! Shame about your penalty though. He probably had a $hitty Christmas and when he saw your car and liked it but thought " I cant afford that on my wages" and thought he would give you some (you cant mess with me buddy!!!) Its about time the law stopped picking on motorists and dealt with real crime that really warrants it. The horn is there on the car for a reason. YOu used it in a situation where it was genuinely needed. Please challenge this....do it for me!! I was sat at some lights in a queue of traffic when the lights went green we all set off on a 50mph dual carrageway. I got stopped for apparently accelerating to fast. WTF I was still behind the queue of cars and could go as quick as they were. I took the knobs name and pc number and went to the station and complained. A few days later I got an apology through the post. If I was you I would complain about it worth a try. Best advice I reckon. When I got unjustifiably pulled over monthly I learnt the best reaction was to take the plods number, be polite at the time of the "telling off", then head straight to the police station and make a big complaint. If you get pulled over too many times with no reason (i.e. no points but pulled over 8 - 10 times in a year) you can also sue them for that as well. Don't let the jealous piggies get away with it.
