supRo Posted May 10, 2005 Share Posted May 10, 2005 Hello, Just been stopped on a dual carriageway by the police (Dog section). I was doing 110. He gave me a producer for my documents and said he will think about prosecuting me. I didn't get a 'Notice of Intended Prosecution', not yet anyway. He was really rude to me! Apart from being a copper, what would be concrete or sufficient to prosecute me? He had a navigation system that displayed that he was doing 110 behind me. He was the only copper. Am I fooked? Funnily enough my girlfriend happened to be driving down the contra flow of the dual carriageway and rang me! I didn't answer, she left a voice mail " I just saw you with a copper, you don't look too happy..."!!! Any thoughts on the likelyhood of being prosecuted? wkdtime Posted May 10, 2005 Share Posted May 10, 2005 It depends if he had video evidence aswell, i.e video of your car and him following you at 110 would be pretty damning for you, if he hasnt then as far as i am aware they cannot prosecute, or he might actually be a decent copper and forget all about it! TBH honest if he hasnt given you a N.I.P, then i really wouldnt worry about it, just make sure your extra polite when you hand over you documents. Class One Posted May 10, 2005 Share Posted May 10, 2005 Ok, for speeding offences, you either at the time have to be issued with a fixed penalty notice or the PC HAS to say something along the lines of " You will be reported for the consideration of reporting you for the offence of...." and tell you what offence he is reporting you for. I can't answer for Beds Police as i don't know their set up, but unless he has speed recording equipment in his vehilce (unlikely if he's dog section) he will have to take his van out of service to a force rolling road to have the speedo calibrated. This is hassle for him and his colleagues cos it'll mean being without a vehicle and we all know coppers don't like walking (oooh me knees!!) Giving you a producer and then saying he'll think about wether he's going to stick you on isn't correct procedure so you Might be in the clear. EDIT: For info, in England & Wales you do NOT need two coppers to report you for ANY offence. This system operates in Scotland for certain offences. So don't be under any misconceptions that a single copper cant do cos he can. Video evidence helps but some vehicles carry speed caluculationg equipement which will give a mean speed between two fixed points. Some forces operate double crewed vehicles for Officer safety purposes (its a dangerous world out there). PM me if you need any further advice, happy to help.
