Lurch Posted September 22, 2009 Share Posted September 22, 2009 Hello all. I got a parking ticket yesterday because I parked on a dropped curb (pedestrian). I didnt see it as I was running late for a trainning course. Anyway, looking at the ticket it seems the traffic officer hasn't signed the ticket. Anyone know if I can get out of it? And how? The ticket was printed, but there was a bit for a signature which hasn't been signed... Class One Posted September 23, 2009 Share Posted September 23, 2009 The only way to fight a council issues parking tickey is to request arbitration. This sin't a Court, and therefore the burden of proof is not the same as that required of a court. Most cases that go before arbitration fail. The fact of the matter is, that you did park in contravention of the regulations. The fact that the ticket in this instance was not signed when placed before the abitration panel will be neither here nor there. AJI Posted September 23, 2009 Share Posted September 23, 2009 I contested a ticket a couple of years back.... basically it was a disc zone whereby you set the arrival time and have 1 hour parking before you have to move. I had set the time but as my watch and the parking piglet's watch was a few minutes out they tried to do me for a descrepency of 4 or 5 minutes, saying I had set it too early. They were literally waiting behind a dark corner and sprung out to get my car as soon as I was out of sight. I contested this and won. Just a written letter explaining the situation to the ticket office was all that was needed. But I do think it is heavily dependant on circumstances. You can easily get away with it for reasons such as non-clear road markings, non-clear signing etc. And of course small discrepancies with the dics zone timings. (As these are things they have to have correct in order to put you in the wrong). But if you are clearly in the wrong then there is no defence really, unless the council department really want to let you off with it.
