brucie-bonus
Ok ladies and gents, hoping someone could give me a bit of advice as I can't find much. Took the car for it MOT a few days ago and sadly it failed on 'offside front brake juddering severely'. Spoke to the guy at the time and he said I needed new brake discs and pads and were looking for 400 quid. Wasnt paying that so took it away, bought the parts from Mr T and did the work myself. Went back today after the re-test to be told by a different guy, the brake discs and pads were fine, the problem is the offside brake is binding. Looks like Ive wasted £200 on discs and pads after them telling me I needed them when I didn't. Is there anything I can do? Do I even have a leg to stand on in this situation? Cheers folks
Gaz6002
You could have got a second opinion before changing the discs... I think you've screwed yourself unfortunately
Havard
You could have got a second opinion before changing the discs... I think you've screwed yourself unfortunately As above..!! It's all he said, she said stuff. I doubt you would be able to persue this legally with any success..... H.
pbryant_knight
Well, if it was a decent Garage (and not a back street job) you could certainly take the pads and discs to the dealer for a second opinion. then take the whole lot back to the garage and chance your luck. You may not have a leg to stand on, but you sure as hell have nothing to lose by trying. Peter
AdzC
Unfortunately if they haven't actually carried out the work then I don't believe they garage are liable. If they had done the work and then the brakes were binding then that would be a different story. Good luck and hope you get it sorted. Technically someone can be liable under the tort of negligence for giving advice if you relied on that advice and it was reasonable in the circumstances for you to rely on the advice. A claim of negligence would cost a lot more than £200 though.

brucie-bonus
Aye, didn't think there would be much grounds. Certainly not goning to take any sort of legal action or anything, just thought I'd see where I stand. It would have been something I would have done in the future but I would have prefered not to at the moment (going on holiday in a week:d). Thanks again guys

AdzC
God thats twice tonight it looks like I have been rude to you... again no insult was intended Ha ha. I didn't read that as you were being rude to me just that you evidently have a much better knowledge of civil law and tort than I do.
