Road Tax when parked on a Private Road

My house is accessed by a private road leading down to it that is a public right of way on foot only (AFAIK).

 

Residents have easements allowing them access, so it is used for parking by them. The council has no responsibility to maintain this road.

 

Do I still need to have road tax when parked there, or is it still likely to be classed as the public highway?

 

Is there any site that may help me find out?

That is quite a tough question.

 

I live on a forces married estate, we have regular military and gaurd patrols around the estate and it is own purely by the mod, but when i went on tour to Iraq i sorned my car and nearly got into trouble for not having a tax disc.

 

when i questioned the police as to why they told me anything that the public can get to, you will need a valid tax disc.

Yes you would need to advise DVLA of SORN but if it is a private road then you can park on it without any road tax. If you have no road tax & even if it is SORN then on a public road is a no no as they clamp the car.

 

In your scenario it is a bit difficult, but if it is accessible by the car then they would clamp it as it is sitting on public road. You would be best to get a confirmation from the local council via writing.

Thanks for all the replies - pretty much what I thought tbh. The road's status is quite difficult to pin down in terms of ownership, as it was the access for the local mill until there was further development (around 1900 :D) of housing, but it's definitely not owned by the council.

 

My gut instinct tells me that even if it turns out I can do it with a SORN i'll probably tax it anyway just to avoid the aggro of having to constantly battle clipboard hitlers who think otherwise.
