Pete Posted April 20, 2005 Share Posted April 20, 2005 I've been having a read of http://www.pepipoo.com/ and it says that if you don't get a NIP (Notice of Intended Prosicution) within 14 days everything is null. Today I've come home to a "You were out" message from the postie. I'm guessing it's an NIP from an incident on Sunday night. Noticed the hard shoulder was coned off on the M40 but all three lanes were flowing ok when I spotted I was going over a speed camera lines on the road jobby. That's ok I thought, I'm only doing 60... Oh dear, what's that large 40 sign... oh bum. Annoying thing was I'd JUST joined the motorway, didn't see any restriction signs and the only thing closed was the hard shoulder. No roadworks - nothing. kosmic Posted April 20, 2005 Share Posted April 20, 2005 They never send a NIP by registered post or by hand. Its sent standard post..usually to determine the keeper/driver. Oh and its 14 days + 2/3 days postage for the NIP to be valid, so if you receive it on or after the 17th day...you should be fine.....fingers crossed....(think thats right)! The only problem is that it's in Vickis name and she's a bit more straight laced than me about this stuff. Class One Posted April 21, 2005 Share Posted April 21, 2005 Can't do this too often though, if other coppers stop you in the meantime and it flags up in their computer they can serve you with the papers there and then, and that will be the end of that line of 'defence' Best is to avoid attracting attention in the first place.... Nope what will happen is you'll probably get nicked on a bail warrant on the spot!! With NIP's and a Summons , it only needs to be served ie issued NOT received to prove service. There are numerous stated cases on non service of summons and NIPs but the law is quite clear in this area. I will PM you with some further advice.
