mkirby Posted May 27, 2009 Share Posted May 27, 2009 Did a job for a woman last week, she wanted amtico throughout her new flat so we did the hall, kitchen/dining/living room and bathroom and it looked stunning and she is very please with it. She also wanted carpet in her bedroom but never decided on the carpet until mid last week so i ordered it and it comes in this friday. Gets a call on friday the day she moves in to say why have we not put a door back on or the kitchen plinths, i explained to her that i had already told her than she would need to get the house builders to trim them as they had been cut to the floor boards!! but she played the "poor little old lady on her own" trick so i went there on saturday and trimmed them all, i even plumbed in her washing maching to help her out. Anyway gets a call today from her saying she does not want her carpet done by us anymore as she feels let down as it wasnt done last week??? WTF and to cover the costs of getting someone else in to do it she has cancelled the cheque I'm sooooo mad, we have gone out of our way for this woman and she's trying to rip us off, christ sake we were doing the carpet on friday and she cant wait 2 days I know we can sue her but its the hastle and the job was bloody hard work AND this is the job i tw@tted my thumb on so i'm not a happy bunny. You need to explain to her that the flooring has already been purchased for her and she will be billed accordingly (whether she has it just supplied and then fitted by someone else). Anything in writing is always a good one. She must have signed the agreement...right! Hope you get paid and everything turns out 'rosie' in the end. Don't get nasty or anything, keep it polite and if she still refuses, either take her to court or pull up the floor. Why should you be out of pocket, just keep it professional. extendor Posted May 27, 2009 Share Posted May 27, 2009 Seems like a chancer to me. Can you clarify if the cheque she cancelled included the flooring. Personally I would say that until the goods are paid for they are your property. Title of goods does not pass to the purchaser until the goods are paid for in full and the risk in the Goods shall pass to the buyer. This is a standard retention of title caluse you should have in your contract. You can argue that if she damages them by walking on them that is criminal damage. You can very politely remind her that you will go to court to get a restraint preventing her from damaging your goods (ie forbidding her from walking on the floor) whilst in her care and you are to be given access within seven days in which you can reclaim your goods or repossess them via a bailiff if necessary. People are unwilling to take responsibility for any adverse consequences of their own actions or decisions. People like her run around looking for someone to blame, whereas most of the time all they'd need is a mirror. mkirby Posted May 27, 2009 Author Share Posted May 27, 2009 cheers guys, we havnt billed her for the carpet as we havnt done the work and part of me does want to go round there and rip it all up but it cannot be reused and theres plywood down which has been ring nailed down so it would take us all day just to rip it up ive been in touch with our solicitor and he says just sue her, she is trying it on so dont mess around with her give her a chance to pay up again and if you dont get the cash this week then start the ball rolling!! small helpless old lady my arse!! tbh ive been very calm with her and explained that the carpet work and the amtico work are two separate things and that my solicitor has informed me she has no leg to stand on as she has already issued a cheque for the work completed so she is flapping a bit at the moment and offered me most of the money but i want all of it, why should i accept less? She shouldn't use this as an excuse to re-negotiate the price. If she has a genuine grievance about the work and why the price should be lowered, she should speak to you about it, but I imagine she'll just try to go round and round the same arguments without proving anything, getting more flustered on each iteration.
