Garage advice

Hi guys and gals, need some advice as i dont have a clue where i stand with a garage i bought a car from last month.

 

Basically i sold the soop to get a cheaper car to run for a bit so i went for a 53 BMW 320Cd sport. I found one advertised on a local car dealers website and basically ended up getting it.

 

The dealer said he was selling it on behalf of someone so technically it was a private sale .. apparnetly, which meant i didnt get the 3 months warrenty you do with all other dealers. At the time i thought nothing of this and took out some 2 year silver cover thing for £299 which he claims covers everything except wear and tear.

 

Anyway, about a couple or so weeks after i got the car the alarm started playing up, and ive been busy with work so only just managed to get the car into bmw today, thinking this daft warrenty i got would cover the alarm (turns out it doesnt). Got a call saying it needed a new boot latch, sorted i though, but nooooo! he says we found other problems with the car and he rambled of a list of parts it needed which came to around £1500!! oh and its all classed as wear and tear soooo that warrenty is a no go.

 

what i want to know is where do i stand with this dealer i got the car from, the car was advertised on their website, they sold me it, so because it all went through the dealer should i actually be getting some form of warrenty or not? i get the feeling the V5 document was still in the last owners name but the yellow part of the V5, the transfer/sale to a dealer wasnt there.....

 

Is there no such thing as a "private" sale through the dealer? Is the dealer just trying to fob me off or what?

 

Obviusly the £1500 of parts i need acording to bmw i could no doubt pick up for a 1/3 of the price but thats still £500 i dont want to have to pay when ive only had the car a month.

Have you had the V5 back yet? Who is the stated previous keeper?

 

Yea i have the V5, its in the lads name who had it before me, not the dealer :(

 

The garage had hold of all the service books etc but i dont think they bothered to put their name on the V5, i dont know how it all works to be honest.

When did you buy the car? Do you have a receipt etc? Is there anything on it that says its a private sale etc etc?

 

Sounds to me like they knew it was a bit iffy.

 

I got it a month a go tomorrow, the closest i got to a recept is him writing " £**** paid in full along with the reg and spec of the car" on the back of his business card . Theres nothing that specifically says its a private sale that i can see.

 

Yeah how long have you had it ? Was this a BMW dealership?

Check your rights then mate. If you buy from a dealer they are legally responsible for that car for a certain amount of time.

 

It may be a month btw, it could be more though. I think if its a private sale between regular joes you are still accountable for a fortnight.

Yea i was thinking something like that, i tried to ring the citizens advice but my local office was closed.

 

Anyone know anywhere i can call at this time of night?

No idea mate, definitely make a point of speaking to someone tomorrow though and having the complaint recorded.

 

Also, do you have an invoice for the estimate of work to be done? Just so that you have proof of the date ;)

yea im planning to mate.

 

Yeeeep i got bmw themselfs to print out what it needs and how much for it all, should all be dated today, my girlfriend picked up the car so havent actually had a look at the list yet.

Sounds as if this guy is taking you to the cleaners matey. Did you hand over cash or a cheque/bankers order and who did you give it too? If you have bought it through the dealer then he must warrant the vehicle unless the two parties have officially signed a 'sold as seen' caveat to the transaction. He could however pull a flanker to say that you effectively agreed to a sold-as seen purchase as he had made you aware that the vehicle was a personal transaction.

 

Don't worry about the 1-month period since the date of purchase - that is not a long time at all and all punters would expect a vehicle to maintain its road worthiness capability for more than 30-days. There is no official timeline highlighted under the terms of the Sales of Goods Act which stops you from initiating a legal claim for compensation or repair. The period has to be 'reasonable' as per the terms of the Act.

as far as i know a dealers warranty would just cover 'major mechanical breakdown' and not wear and tear either.

Not sure if the sale of goods act would cover it as it would have been sold as seen. It would depend if the parts that needed replacing would be expected to last longer but if its wear and tear then it might be the standard time period as they haven't 'broken'

 

Although your post got expensive when you said you took it to a BMW garage, i'd take it back to where you got it from and let them look at it and give you a quote for sorting it out. Ask for a discount on it as well because they sold it you.

I think the main thing is if you brought it from the dealer & he provided you cover this is the main thing you should be looking at. I would take it back to the dealer you brought it from. There is a period from a dealer in which the car must stay in its a certain good condition, I am not sure how long this period is. Make sure he has not signed the receipt as saying "sold as seen", this means you have brought it in the condition it is in.

 

I believe the alarm should be covered under the warrenty as long it is not after market though wear & tear will not be. Remeber BMW themselves will quote you a very high price for work which needs to be done for example suspension bushes etc which need to be changed can easily come to £1k.
