Benyon Posted April 21, 2009 Share Posted April 21, 2009 For the First time in 6 years I have been caught speeding 74mph in 60 zone. I personally believe I was doing 65 but it doesnt matter. Did you sign for it? They usually send the letters out recorded delivery. A little loophole saw me wave goodbye to a court summons for 98 in a 70. Any lawman worth their salt would have gotten you out of that one. I've only ever heard of increased fines when going to court, not increased points. I did get a bit worried at this time and left it for another week, then i sent the original NIP off to them and they said that i would have to go to court because of the speed i was doing but 3 years on still not been to court. In a 30 limit that makes it 35, in a 70 its 79 etc etc etc. They can nail you if they want to for 1mph over 30 though. The thing with the camera is the calculation is only accurate to 5mph as far as i know. If you get done for 33 with a speed camera the lines painted on the road aren't THAT good. They HAVE to make an allowance for tolerancing. If the soliciter had half a clue he would have followed up from that angle. Last part, different wheels?? Ignorance is not an excuse. You are the one that has changed the car. Claiming ignorance to your speed would only see you, probably, done with driving without due care and attention. Personally i would attempt to argue that one based on the fact speedos are normally about 10% out and your speedo is not checked on an MOT, however it is a requirement that you keep your car roadworthy etc but i have never seen a speedo calibration service advertised. Considering the speed you were travelling compared to the limit i would be inclined to take it on the chin and be as contrite as possible. Sorry to hear about you losing your license, i can understand your frustration. The Procurator Fiscal can get things wrong too though, the loophole i got through probably saved my license tbh, and it was all down to her not concentrating on her job. We have to remember the people dealing with these cases are only human. Mistakes are made every single day. In a case of getting 3 points you are as well to leave it. Especially when your guilty. That loophole has been closed now. I did the same 5 years ago. If it is the same one where as you returned it unsigned. This was due to your right to silence and not incriminating yourself.
