terribleturner Posted April 6, 2005 Share Posted April 6, 2005 Don't really know what to do in this situation. Back last Feb some wazuk pulled out on me while i rode to work on my bike. Thrown off, bike smashed etc.... Didn't really have any bad injures just bruising to one side that gave me a limp for a week or 2. Probably only took 5 days off work of which i got paid as well. But i have just had a letter from my solicitor saying they have offered me £1000 (made on a part 36 basis, what does that mean??). Now, do i take this or do i hold out for a better offer?? I don't think it's too bad, but a friend at work hurt his neck as a passanger in a car and got £3.5K. Then How_supra will tell you about her 7 (i think it was). how_supra Posted April 6, 2005 Share Posted April 6, 2005 Yes £7k payout, but I had to wait 2.5 years as the twit who drove head on into me was not insured and the rest of it, so I had to claim through the motor insurers bureau My payout includes a lifetimes estimated cost of dentistry though as I broke my front tooth on my steering wheel when he hit me I think you should be entitled to much more........you damaged your back - it still plays up now.I say wait.....it's just a first offer I also think you should be re-imbursed for the bike! You should also be able to claim for damages to clothes, helmets and anything in your pockets that potentially could have got smashed. Guest Sakura Posted April 6, 2005 Share Posted April 6, 2005 Part 36 Offers/Payments When your opponent first receives your Claim they can make a personal judgement on how much they ‘believe’ the claim is worth and will make a Part 36 offer. If you do not accept the amount that they offer then the case goes to court for evidentiary hearings as to why you think you should receive more. Be warned, if you refuse to accept the Part 36 offer and the judge awards a lower amount later, the defendant can claim costs from you. Guess i'll have a chat with the solicitor and see what he recons It's not that scary! I think it's standard practice to make a low-ish offer and see if it is accepted. They will want to avoid court if you have a good case with medical back-up for your injuries, but they also want to pay out as little as possible. Knackered ny Arai Quantum F 'Haga blue replica' & my black visor (it ripped the visor off & wore throught the outer shell, scary thought that your face is couple of inches from the road surface) - my fave helmet ever ever ever - gutted!!! bloke lived about 3 miles but his daughter lives 4 house away. anyway, initially his solicitor made me 'one-third liable - him two-thirds liable'. 'We'll go to court then' I said. It took 4 of thieir offers before they conceded liability. Total incl bike repair/earnings/injury £9900. Because I was taking him to court each time an offer was made the money was put int he court's account. Have accepted but its not his solicitor that is playing silly buggers paying up, its the Court!
