If he can hang on to him within a second or two for the first stint then he could change his strategy based on what SV's doing. Yes but they also handed in a meaningless list of demands for them to enter the 2010 championship, which legally they can't do. They may want to drop KERS and it may or may not be the best thing to do, but either way FOTA has no legal power to decide anything. However, if no one turns up to Oz 2010 with KERS then I can't see the FIA stopping the race until they fit it...but there could be a non FOTA car running a 160HP 800KW version as it's thought the FIA were going to ramp up it's kick. Even though we're suspended at the moment, we're still complying with a number of the FOTA agreements. Not sure on the KERS one though. Personally I think it's a grand idea to have KERS.
